利益冲突视角下我国高校腐败问题研究

【摘要】：腐败问题作为一个困扰人类社会的“顽疾”,各行各业都饱受其害,高校领域无疑也受到了腐败的困扰。十八大以来,党中央不断加大反腐败力度,开展巡视工作,查处了大量的高校腐败案件,反腐败效果显著的同时,也表明了当前我国高校反腐败形势的严峻性。为了有效防治高校腐败,必须辅之以新的理论和模式,探究有效遏制高校腐败问题的对策,让“象牙塔”重归圣洁。利益冲突作为一个廉政学概念,由西方引入中国并广泛应用在反腐领域。许多国家和地区的反腐败经验表明,利益冲突是腐败的重要根源,有效防止利益冲突是防治腐败的根本措施。细究我国腐败案件可以发现,每一桩高校腐败案无不牵扯利益冲突问题,因此,欲从源头上防治腐败,必须以防止利益冲突为抓手,构筑高校公职人员私人利益与公共利益之间的“防火墙”,阻断高校公职人员以权谋私的可能渠道。本文综合运用历史研究法、文献分析法、案例分析法等研究方法,依托防止利益冲突的观点,结合高校腐败的现状和危害,在深入剖析高校腐败问题原因的基础上,提出解决高校腐败问题的具体对策。研究发现当前我国高校腐败性质严重、手段隐蔽、高发领域利益冲突问题集中、兼职现象严重,这些问题的存在无疑阻碍了高校的健康发展。从利益冲突视角来看,造成高校腐败问题的成因是多方面的。主观上,部分高校公职人员价值观扭曲,法治观念落后,不能自觉站在高校公共利益的立场上开展工作;客观上,防止高校利益冲突的法律制度不健全、监督落实不到位,从而滋生了高校公职人员贪污腐败的土壤,导致了高校腐败现象的产生。最后,针对我国高校腐败问题产生的原因,从利益冲突视角提出建设性的对策:加强高校公职人员道德伦理建设,为防治我国高校腐败构筑坚定的思想堡垒;加强高校防止利益冲突制度建设,为防治我国高校腐败提供强有力的制度保障;注重防止利益冲突相关法律建设,为防治我国高校腐败提供有力的法律支撑;完善配套的高校监督机制,为防治我国高校腐败提供有效的约束机制,达到从根源上防治高校腐败的目的。
[Abstract]:As a "stubborn disease" that puzzles the human society, the corruption problem has been suffered by all kinds of industries, and the field of higher education is undoubtedly beset by corruption. Since the 18th National Congress of the CPC, the CPC Central Committee has continuously stepped up efforts to combat corruption, carried out inspections, and investigated and dealt with a large number of corruption cases in colleges and universities. While the anti-corruption effect is remarkable, it also shows the seriousness of the current anti-corruption situation in colleges and universities in China. In order to effectively prevent and control corruption in colleges and universities, we must use new theories and models to explore the countermeasures to effectively curb corruption in colleges and universities, so that the ivory tower can be restored to holiness. Conflict of interest, as a concept of clean government, was introduced into China by the West and widely applied in the field of anti-corruption. The anti-corruption experiences of many countries and regions show that conflict of interest is an important source of corruption, and effective prevention of conflict of interest is the fundamental measure to prevent corruption. A careful study of corruption cases in China can find that every corruption case in colleges and universities involves the issue of conflict of interest. Therefore, in order to prevent corruption from its source, we must take the prevention of conflicts of interest as the starting point. To build a firewall between the private interests and public interests of public officials in colleges and universities, and to block the possible channels for university public officials to use their power to seek personal gain. This article synthetically uses the historical research method, the literature analysis method, the case analysis method and so on, relies on the viewpoint of preventing the conflict of interest, unifies the university corruption present situation and the harm, in the thorough analysis university corruption question reason foundation, This paper puts forward the concrete countermeasures to solve the problem of corruption in colleges and universities. The study found that the corruption in colleges and universities in our country is serious, the means are hidden, the conflicts of interest in high incidence areas are concentrated, and the phenomenon of part-time work is serious. The existence of these problems undoubtedly hinders the healthy development of colleges and universities. From the angle of conflict of interest, the causes of corruption in colleges and universities are various. Subjectively, some public officials in colleges and universities have distorted values, backward ideas on the rule of law, and can not consciously stand on the standpoint of public interest in colleges and universities to carry out their work; objectively, the legal system to prevent conflicts of interest in colleges and universities is not perfect, and the supervision and implementation is not in place. Thus, the soil of corruption of public officials in colleges and universities is bred, and the phenomenon of corruption in colleges and universities is produced. Finally, in view of the causes of corruption in colleges and universities in China, this paper puts forward constructive countermeasures from the angle of conflict of interest: strengthening the moral and ethical construction of university public officials and building a firm ideological fortress for preventing and controlling corruption in colleges and universities in China; Strengthening the system construction of preventing conflicts of interest in colleges and universities, providing strong system guarantee for preventing and controlling corruption in colleges and universities in our country, paying attention to the construction of laws related to preventing conflicts of interest, providing powerful legal support for preventing and controlling corruption in colleges and universities of our country; To improve the supervision mechanism of colleges and universities, to provide an effective restraint mechanism for the prevention and control of corruption in colleges and universities in China, and to achieve the purpose of preventing and controlling corruption in colleges and universities from the root.
