中国传统社会的德法关系及其伦理实践

【摘要】：建设中国特色社会主义法治必须坚持依法治国和以德治国相结合,德法融合需要从中国传统文化中寻获文化自信与民族自信。在中国传统社会中,礼法合治只是中国传统德法关系之表象,伦理实践亦只是中国传统社会德法关系之具象。只有看清阶级统治秩序下道德与法律关系的真相,剔除束缚民众的封建礼制,方能弘扬民众在日常生活中体认的德法之真义。道德与法律不仅仅是调整社会关系、约束人的行为的两类规范体系,更是人的两种重要生活方式。党的十九大再次吹响"良法善治"的号角。法治只有扎根于中华文化沃土才能获得更多的鲜活内容,使德法共治融合在新时代中国特色社会主义背景下,焕发出新的生机与活力。
[Abstract]:To build the socialist rule of law with Chinese characteristics, we must combine the rule of law with the rule of virtue, and the fusion of morality and law needs to find cultural confidence and national confidence from Chinese traditional culture. The rule of propriety and law is only the appearance of the traditional relationship between Germany and France in China, and the ethical practice is only the embodiment of the relationship between morality and law in the traditional Chinese society. Only by seeing the truth of the relationship between morality and law under the order of class rule and eliminating the feudal ritual system which binds the people, Morality and law are not just two kinds of normative systems that regulate social relations and restrain people's behavior. 19th CPC National Congress of the Party once again sounded the trumpet of "good Law and good Governance." only if the rule of law is rooted in the fertile soil of Chinese culture, can more fresh content be obtained. Under the background of socialism with Chinese characteristics in the new era, the combination of Germany and France is full of new vigor and vitality.
