行政法治与行政德治的平衡机制探析——以制度伦理的重塑为视角

【摘要】：行政行为不仅关乎行政法治,而且涉及行政德治,寻求二者的平衡机制,从根源上寻求化解之法,已成为当前的重要议题。转型时期,行政行为失范表现为:政治与行政趋同化、自由裁量权随意化、行政权力泛道德化。制度伦理是国家治理体系和治理能力现代化的重要组成部分,因此,重塑制度伦理是实现顺利转型的必由之路。
[Abstract]:Administrative behavior is not only related to the administrative rule of law, but also involves the administration by virtue. It has become an important issue at present to seek the balance mechanism of the two and seek the law to resolve them from the root. In the transitional period, the administrative behavior is characterized by the assimilation of politics and administration, the arbitrary discretion and the general moralization of administrative power. Institutional ethics is an important part of the modernization of national governance system and governance ability, so remolding institutional ethics is the only way to realize the smooth transformation.
