反思艾滋病反歧视

【摘要】：在法律和道德层面,人们达成了诸多反歧视共识。然而面对"艾滋病毒感染者能否当老师"这个复杂事件时,反歧视的专家批评意见与非歧视的公众自我评价之间呈现矛盾的状态。这种矛盾状态的背后隐含着反歧视与非歧视的解释鸿沟。从法律的描述性、伦理的规范性和实践的合理性三个层面反思艾滋病反歧视,或许可以为"反歧视-非歧视"问题提供参考。
[Abstract]:At the legal and moral level, people have reached a lot of anti-discrimination consensus. However, in the face of the complex issue of whether people living with HIV can be teachers, there is a contradiction between the opinions of anti-discrimination experts and the nondiscriminatory public self-evaluation. There is a gap between anti-discrimination and non-discrimination behind this contradiction. The reflection on HIV / AIDS anti-discrimination from the three aspects of legal description, ethical normative and practical rationality may provide a reference for the issue of "anti-discrimination-non-discrimination".
