论国际禁毒公约与我国毒品犯罪的惩治

【摘要】： 由于我国毗邻世界两大毒品产地——“金三角”和“金新月”,毒品犯罪问题日益突出。本文欲通过探究、借鉴国际禁毒公约及国际社会惩治毒品犯罪的先进立法措施,弥补我国惩治毒品犯罪方面的立法及司法缺陷,严厉打击我国毒品犯罪,广泛开展同国际社会的禁毒司法合作,以期对遏制毒品犯罪,最终彻底消灭毒品对全人类的危害有所裨益。论文主要内容如下: 第1章:首先探究了毒品犯罪的概念,接着从国际社会及我国两个方面分别对毒品犯罪的历史、现状及成因做了分析、比较。第2章:回顾国际禁毒公约的立法沿革,介绍公约对毒品犯罪的认定及防治手段,进而探寻国际社会惩治毒品犯罪的立法概况及其特点。第3章:具体查找我国惩治毒品犯罪立法方面的进步与不足之处,并对比、分析了国际社会惩治毒品犯罪的立法状况与中国立法之不同。第4章:从对毒品犯罪的认定与惩治两个方面,借鉴国际禁毒公约及国外各国先进立法经验和司法实践经验,对我国惩治毒品犯罪的立法和司法实践中的一些问题提出具体建议。第5章:依照国际禁毒公约在国际禁毒司法合作方面的规定,对我国参加国际司法合作情况加以概述,并提出我国加强、完善国际司法合作的具体措施。
[Abstract]:Because our country adjoins the world's two major drug producing areas-"Golden Triangle" and "Golden Crescent", drug crime problem is increasingly prominent.This paper aims to make up for the legislative and judicial shortcomings of our country in punishing drug crimes by referring to the international drug control conventions and the advanced legislative measures of the international community to punish drug crimes, so as to severely crack down on drug crimes in our country.The judicial cooperation with the international community in drug control is widely carried out in the hope of curbing drug crimes and eliminating the harm of drugs to all mankind.The main contents of the thesis are as follows:Chapter 1: the first part probes into the concept of drug crime, and then analyzes and compares the history, present situation and causes of drug crime from the two aspects of international society and our country.Chapter 2: review the legislative evolution of international drug control conventions, introduce the identification and prevention of drug crimes, and then explore the general situation and characteristics of the international community to punish drug crimes.Chapter 3: find out the progress and deficiency of the legislation of punishing drug crime in our country, and analyze the difference between the legislation of the international community and the legislation of China.Chapter 4: learn from international drug control conventions and advanced legislative and judicial experience of foreign countries from the two aspects of the identification and punishment of drug crimes.Some suggestions on the legislation and judicial practice of drug crime in China are put forward.Chapter 5: in accordance with the provisions of international drug control conventions on international drug control judicial cooperation, this paper summarizes the situation of our country's participation in international judicial cooperation, and puts forward concrete measures to strengthen and perfect international judicial cooperation.
