精神疾病与刑事责任相互关系研究

【摘要】： 辨认能力和控制能力是现代刑法判断行为人责任能力的基本条件,也是精神病人是否要承担刑事责任的判断依据。与其他生理性疾病相对而言,精神疾病的诊断难以把可数量化的客观指标作为依据,更多地依赖于临床表现的观察和分析。然而,各种精神疾病的表现可谓纷繁复杂,这不仅给精神疾病的诊断也给责任能力的判定带来了困难。限于当前精神医学的水平,在精神疾病与刑事责任之间建立相互联系的最佳途径就是对精神症状的分析和考察。首先,分析哪些异常的精神表现是属于“无法辨认”、“无法控制”、或“不能完全辨认”、“不能完全控制”,这样就能够在责任能力和精神症状之间建立起相关联系;其次,与责任能力相关的精神症状由哪些疾病导致的,也就是说哪些疾病会导致患者出现“无法辨认”、“无法控制”或“不能完全辨认”、“不能完全控制”的精神症状,从而失去了责任能力。通过对精神症状的分析研究,揭示出精神疾病和责任能力之间的相互联系。本文按照这一思路,以“辨认能力”、“控制能力”作为研究的理论基础,以精神症状作为研究的客观基础,分析了各种精神疾病与责任能力的相关性,从精神病理学的角度为刑事责任能力的主观要素的判断提供切实可供参考的标准和操作手段。
[Abstract]:The ability to identify and control is the basic condition of the modern criminal law to judge the responsibility of the perpetrator, and it is also the basis of the judgment of whether the mental patient should bear the criminal responsibility.Compared with other physiological diseases, the diagnosis of mental diseases is difficult to take quantifiable objective indicators as the basis, and depends more on the observation and analysis of clinical manifestations.However, the manifestations of various mental diseases are complicated, which not only brings difficulties to the diagnosis of mental illness but also to the judgment of responsibility ability.Limited to the current level of psychiatry, the best way to establish a relationship between mental illness and criminal responsibility is to analyze and investigate mental symptoms.First of all, analyze which abnormal mental manifestations are "unidentifiable", "uncontrollable", or "not fully identifiable", "can not be fully controlled", so as to establish a correlation between the ability of responsibility and mental symptoms;Secondly, the mental symptoms associated with the ability to be responsible are caused by what diseases, that is, which diseases lead to mental symptoms that are "unidentifiable", "uncontrollable" or "not fully identifiable", "not fully controlled",Thus losing the ability to be responsible.Through the analysis of mental symptoms, the relationship between mental illness and responsibility ability is revealed.According to this idea, this paper analyzes the correlation between various mental diseases and the ability of responsibility, taking the ability of identification and control as the theoretical basis, and the mental symptoms as the objective basis of the study.From the point of view of psychopathology, it provides a practical standard and operational means for judging the subjective elements of criminal responsibility ability.
