【摘要】：酒后驾驶已成为损害行为者自身生命财产安全乃至公共安全的一大公害,是公共生活领域中关系公众公共利益的一种公共性行为。作为实现和维护公众公共利益的主体,政府及其相关部门采取有效措施妥善治理这一公害是其当然使命。近年来,我国政府在治理酒后驾驶行为方面积累了宝贵的经验,也取得了较好的成效。但问题仍然存在,有意识观念上的,有体制机制上的,有法律依据上的,也有能力上的。这些问题在不同程度上都影响了政府及其相关部门对于酒后驾驶公共安全治理的成效,必须加以改革。本文以公共治理等理论为分析框架,运用文献研究、比较分析、辩证分析以及案例分析等综合性的研究方法,详细剖析了我国政府及其相关部门在治理酒后驾驶行为方面存在的若干问题,在此基础上,提出了相应的应对措施。本论文共分为六个部分。第一部分即导论。此部分交代了选题的背景及意义,做了较为详细的文献综述,最后分析了文章的研究方法与基本内容。第二部分对论文中涉及到或者用到的相关概念与理论基础进行了分析。首先介绍了酒后驾驶和公共安全管理等核心概念,接着介绍了论文中可能用到的理论分析框架。第三部分分析了酒后驾驶产生的原因及对其进行管理的必要性。第四部分剖析了政府针对此问题的态度,重点是分析政府在治理过程中还存在着哪些方面的问题与不足,回答的是“是什么”的问题。第五部分针对第四部分的问题,提出了解决问题的几点对策,回答的是“怎么办”的问题。第六部分也就是结语部分指出了论文已经取得的研究成果、研究的不足及今后努力的方向。
[Abstract]:Drunken driving has become a public hazard which damages the safety of life and property and even public safety. It is also a kind of public behavior related to the public interests in the field of public life. As the main body to realize and safeguard the public interest, the government and its related departments take effective measures to properly control this public hazard. In recent years, our government has accumulated valuable experience and achieved good results in controlling drunk driving behavior. But there are still problems, conscious ideas, institutional mechanisms, legal bases, and capabilities. To some extent, these problems affect the effectiveness of the government and its related departments in the management of public safety of drunk driving, which must be reformed. This paper takes the theory of public governance as the analytical framework, using comprehensive research methods such as literature research, comparative analysis, dialectical analysis and case analysis. This paper analyzes in detail some problems existing in the administration of drunk driving in our government and related departments, and puts forward corresponding countermeasures on this basis. This thesis is divided into six parts. The first part is the introduction. This part describes the background and significance of the topic, makes a more detailed literature review, and finally analyzes the research methods and basic content. In the second part, the related concepts and theoretical basis are analyzed. This paper first introduces the core concepts of drunk driving and public safety management, and then introduces the theoretical analysis framework that may be used in this paper. The third part analyzes the causes of drunk driving and the necessity of its management. The fourth part analyzes the attitude of the government to this problem, focusing on the analysis of the government in the process of governance in what aspects of the problems and deficiencies, the answer is "what" question. In the fifth part, the author puts forward some countermeasures to solve the problem, and answers the question of "how to do". The sixth part, the conclusion part, points out the research achievements, the deficiency and the direction of future efforts.
