济南市未成年犯罪社区矫正情况调查报告

【摘要】：我国正处于社会经济快速发展时期，经济发展的同时相应产生了一些负面社会影响,比如离婚率的上升、留守儿童的出现、贫富差距越来越大等一系列社会问题，而这些社会问题导致了未成年犯罪率的上升。未成年是国家的未来，民族的希望，积极控制未成年人犯罪以及给未成年一个良好的生活环境是摆在我们面前的重要任务。目前各国普遍采用社区矫正惩治未成年犯，根据其矫正效果看，社区矫正制度对预防未成年再犯罪起到了重要作用。我国在未成年犯罪社区矫正实践中才刚刚起步，现存的有关社区矫正方面的法律条文几乎没有，传统的未成年犯矫正模式又不能起到应有的效果。因此，借鉴国外未成年犯罪社区矫正成熟做法，结合我国未成年犯罪社区矫正存在问题及有益探索，构建具有中国特色的未成年犯罪社区矫正体系，是摆在我们面前的首要任务。 本文共分为五个章节，以山东省济南市未成年犯罪社区矫正试点为视角，并借鉴社区矫正历史悠久的美国、加拿大、日本未成年犯罪社区矫正经验，最后提出了完善未成年犯罪社区矫正的几点建议。 本文主体分五大部分。 第一章着重介绍了社区矫正工作在山东省济南市试点全面试行情况。首先分析了近三年未成年的犯罪特点，其次对济南市社区矫正情况进行了分析。 第二章主要介绍了济南市未成年犯罪社区矫正的有益探索及存在问题。首先提出有益探索，其中包括矫正项目多样化、矫正工作人员分工明确、重视保护救济、制定矫正细则四个方面；其次提出了矫正机构存在问题。 第三章主要介绍了国外未成年犯罪社区矫正情况考察和经验借鉴。对美国、加拿大、日本社区矫正特点进行了分析。 第四章主要介绍了完善我国未成年犯罪社区矫正制度的必要性，并提出了几点建议。
[Abstract]:Our country is in a period of rapid social and economic development, and the economic development has at the same time produced some negative social impacts, such as the rising divorce rate, the emergence of left-behind children, the growing gap between the rich and the poor, and a series of social problems. These social problems have led to an increase in juvenile crime. Minors are the future of the country, the hope of the nation, actively control juvenile delinquency and give minors a good living environment is an important task in front of us. At present, community correction is widely used to punish juvenile delinquents. According to its correction effect, community correction system plays an important role in preventing juvenile recidivism. Our country has just started in the practice of community correction of juvenile crime, there are almost no legal provisions on community correction, and the traditional correction mode of juvenile delinquents can not play its due effect. Therefore, draw lessons from the mature practice of juvenile crime community correction in foreign countries, combined with the problems and beneficial exploration of the minor crime community correction in our country, construct the juvenile crime community correction system with Chinese characteristics. It is the first task before us. This paper is divided into five chapters, from the perspective of community correction of juvenile crime in Jinan, Shandong Province, and draw lessons from the experience of community correction in the United States, Canada and Japan, which has a long history of community correction. Finally, some suggestions are put forward to improve the community correction of juvenile crime. The main body of this paper is divided into five parts. The first chapter focuses on the pilot trial of community correction in Jinan City, Shandong Province. Firstly, it analyzes the characteristics of juvenile crime in recent three years, and then analyzes the situation of community correction in Jinan. The second chapter mainly introduces the beneficial exploration and existing problems of community correction of juvenile crime in Jinan. First of all, it puts forward beneficial exploration, which includes diversification of correction items, clear division of labor among corrective staff, attention to protection and relief, and formulation of correction rules; secondly, it points out the problems existing in correction institutions. The third chapter mainly introduces the foreign minor crime community correction investigation and experience. The characteristics of community correction in the United States, Canada and Japan are analyzed. The fourth chapter mainly introduces the necessity of perfecting the community correction system of juvenile crime in China, and puts forward some suggestions.
