高科技下的计算机犯罪

【摘要】： 计算机犯罪是计算机技术衍生出来的新类型的高科技犯罪，并伴随着网络技术迅速普及，在数字化时代里必将成为发案率最高、影响最大的一种犯罪，本文阐述了计算机犯罪的定义，即指利用计算机操作所实施的危害计算机信息系统（包括内存数据及程序）安全的犯罪行为。并列举了计算机犯罪在高科技背景下成为一种危及整个人类社会安全的国际化犯罪所带来的危害，和区别于其他犯罪形式的主要特征，计算机犯罪是一种“安全”系数极高的智能型犯罪，其危害性大、侦查取证因难。本文从刑法学的角度剖析了计算机犯罪的构成要件。在此基础上，用较多的篇幅结合我国的刑法条文，将我国刑法规定的计算机犯罪和以计算机操作为手段的牵连犯罪在国内国外的司法实践中的表现形式加以列举论述，并结合国际上针对涉及计算机犯罪的立法、司法实践，，提出我国刑法在打击涉计算机犯罪方面的不足之处。全篇还多处提到了涉计算机犯罪发展的趋势和方向，从而得出预防和制裁计算机犯罪的有效手段就是在健全完善法律的同时加强国际合作的结论。
[Abstract]:Computer crime is a new type of high-tech crime derived from computer technology, and with the rapid popularization of network technology, it will become a crime with the highest incidence and the greatest influence in the digital age. This paper expounds the definition of computer crime, which refers to the criminal act that endangers the security of computer information system (including memory data and program) by using computer operation. And enumerates the harm that computer crime brings when it becomes an international crime that endangers the safety of the whole human society under the background of high science and technology, and distinguishes it from other forms of crime. Computer crime is a kind of intelligent crime with high safety coefficient, which is harmful and difficult to investigate and obtain evidence. This paper analyzes the constitutive elements of computer crime from the angle of criminal law. On this basis, combining the articles of criminal law of our country with more space, this paper enumerates the manifestations of computer crime and implicated crime by means of computer operation in the judicial practice of domestic and foreign countries. Combined with the international legislation and judicial practice concerning computer crimes, this paper puts forward the shortcomings of our criminal law in combating computer-related crimes. The whole article also mentions the trend and direction of the development of computer-related crime, and draws the conclusion that the effective means of preventing and punishing computer crime is to strengthen international cooperation while perfecting the law.
