转型社会家庭功能的变迁与未成年人犯罪研究

【摘要】： 在二十多年以来的改革开放的历史进程中,当代中国的社会组织结构、社会意识、经济体制、社会文化、道德观念等等都发生了重大的变化,这些社会转型变迁的事实,标志着我国当代社会正处在一个从传统社会向现代社会的转型变迁阶段。社会的转型变迁也使人们的婚姻家庭观念、家庭规模与结构、家庭功能、家庭关系等等发生了种种变化。与此相对应未成年人以敏感的心灵感受到时代的变化,未成年人犯罪出现数量逐年增多、低龄化趋势日趋明显、危害日益严重的新动向。本文即以此为背景,围绕家庭功能的变迁与未成年人犯罪这一主题展开分析研究,并力图通过本文对相关问题作出笔者自己的回答。文章从与未成年人日常生活成长紧密联系的家庭经济、教育、感情三功能入手,运用犯罪学、社会学知识,以及统计分析、实证研究等方法,借鉴现有研究成果并进行了综合分析,找出现实家庭功能的变迁中存在的引诱、刺激未成年人违法犯罪的消极因素,结合未成年人自身的特点,多方位、多角度地进行了探讨,并在此基础上提出了相应的预防与矫治未成年人犯罪的对策,以及完善家庭功能的各项社会干预措施。全文共分为四个部分,第一部分首先阐述选题的背景意义、进行了文献的综述,对家庭功能、转型社会进行了界定,并对转型社会中家庭经济、教育、感情三个主要功能的变迁进行了介绍。家庭作为社会的细胞,是一个人社会化过程的起始点。家庭功能能否正常发挥是一个人顺利实现社会化进程的基础和先导。第二部分总结了家庭功能的变迁对未成年人犯罪的影响。首先从未成年犯家庭及家庭功能特点的分析中得出家庭功能的缺失与客观不良是导致未成年人犯罪的重要的影响因素。随后逐个分析了家庭经济、教育、感情功能的变迁对未成年人犯罪的影响。第三部分按照未成年人违法犯罪前中后的时间顺序,论述了家庭功能的变迁与未成年人犯罪的预防和矫治。要优化养育结构保障未成年人健康成长,预防犯罪;对出现问题的儿童要完善家庭功能,防微杜渐;增强家庭情感沟通功能防止重新犯罪及强调家庭功能在未成年犯矫治中的重要作用。第四部分提出了在当前社会转型期很多问题不是家庭自身所能够解决的,应当在社会治安问题控制方略的宏观指导下,注重家庭功能的调适;同时家庭功能的完善,保障未成年人的健康成长,也离不开各项社会干预措施的完善,具体包括社会的支持和法律制度的完善两个方面。
[Abstract]:In the historical process of reform and opening up over the past 20 years and more, great changes have taken place in the social organization structure, social consciousness, economic system, social culture, moral concepts and so on in contemporary China. These facts of social transformation and vicissitude have taken place. China's contemporary society is at a stage of transition from traditional society to modern society. The transformation of society also changes people's concept of marriage and family, family size and structure, family function, family relationship and so on. Corresponding to this, minors feel the change of the times with a sensitive mind, the number of juvenile delinquency increases year by year, the trend of younger age becomes more and more obvious, and the new trend of harmfulness is increasingly serious. Based on this background, this paper focuses on the theme of family function change and juvenile delinquency, and tries to make my own answer to the related questions through this paper. This article starts with the family economy, education and emotion, which are closely related to the growth of minors' daily life, and applies the methods of criminology, sociological knowledge, statistical analysis and empirical research, etc. Drawing on the existing research results and comprehensive analysis, the author finds out the inducement existing in the changes of family function, stimulates the negative factors of juvenile delinquency, and probes into the characteristics of minors in various directions and angles. On this basis, the author puts forward the corresponding countermeasures to prevent and correct juvenile delinquency, as well as various social intervention measures to improve the family function. This paper is divided into four parts. The first part describes the background significance of the topic, carries on the literature review, defines the family function, the transition society, and the family economy, the education in the transition society. The changes of three main functions of emotion are introduced. Family, as the cell of society, is the starting point of a person's socialization process. Whether the family function can play a normal role is the foundation and guide of a person to realize the socialization process smoothly. The second part summarizes the influence of family function change on juvenile delinquency. Firstly, from the analysis of the characteristics of family and family function of juvenile delinquents, it is concluded that the lack of family function and the imperfection of family function are the important influencing factors leading to juvenile delinquency. Then it analyzes the influence of family economy, education and emotional function on juvenile delinquency. The third part discusses the changes of family function and the prevention and correction of juvenile delinquency according to the order of time before and after juvenile delinquency. To optimize the nurturing structure to ensure the healthy growth of minors, to prevent crime, to improve the family function of children with problems, to prevent the gradual development of children; To strengthen the function of family emotional communication to prevent reoffending and to emphasize the important role of family function in the correction of juvenile delinquents. The fourth part puts forward that many problems can not be solved by the family itself in the current social transition period, we should pay attention to the adjustment of the family function under the macro guidance of the control strategy of the social security problem; At the same time, the perfection of family function and the healthy growth of minors can not be separated from the perfection of various social intervention measures, including the social support and the perfection of the legal system.
