黑社会犯罪研究

【摘要】：黑社会犯罪是国际上最为严重的犯罪之一，近年来，在我国一度绝迹的黑社会组织又死灰复燃，严重影响了国家的政治稳定和人民的生命财产安全。刑法第二百九十四条规定了关于黑社会性质组织的犯罪，此后，最高人民法院和全国人大常委会相继出台对该法条的司法、立法解释，为打击黑社会犯罪提供了法律依据。本文拟就中外黑社会犯罪现状及立法情况、我国黑社会犯罪的概念、特征以及对我国有关立法规定的适用及完善作初步分析与探讨。除导言外，本文共分为五个部分，约三万六千字。导言：简述黑社会犯罪的危害，黑社会犯罪在我国的消亡及死灰复燃和我国有关黑社会犯罪的立法概况。第一章：概述中国大陆黑社会组织的发展、现状及类型，介绍境外黑社会组织的概况及立法概况，对我国黑社会性质组织犯罪的一般构成特征进行简要分析。第二章：对中国黑社会(性质)组织的概念、特征、类型及认定进行详细阐述，对“黑社会”、“黑社会性质组织”、“黑社会组织”等问题作深入剖析探讨，说明黑社会组织与通常所说的“犯罪团伙”、“恶势力”及刑法规定的“犯罪集团”、“恐怖主义组织”、“邪教组织”以及单位犯罪的区别。第三章：对我国刑法第二百九十四条第一款规定的“组织、领导、参加黑社会性质组织罪”的构成特征及认定进行专门分析。第四章：对我国刑法第二百九十四条第二、三款规定的“入境发展黑社会组织成员罪”、“包庇、纵容黑社会性质组织罪”的构成特征及认定进行分析。第五章：指出立法对惩治黑社会犯罪的缺陷，对我国当前有关黑社会犯罪的立法规定的适用及完善进行探讨，建议增设“组织、领导、参加黑社会组织罪”、 “包庇、纵容黑社会组织罪”或对典型的黑社会组织犯罪按黑社会性质组织犯罪的从重情节处罚，，建议增设“参加境外黑社会组织罪”，在“包庇、纵容黑社会性质组织罪”中补充包庇、纵容境外黑社会组织犯罪的内容，对黑社会犯罪在立法中明确规定财产刑。关键词:黑社会犯罪研究
[Abstract]:The underworld crime is one of the most serious crimes in the world. In recent years, the underworld organization once extinct in our country has come back again, which has seriously affected the political stability of the country and the life and property safety of the people. Article 294 of the Criminal Law provides for the crime of underworld organizations. Since then, the Supreme people's Court and the standing Committee of the National people's Congress have issued judicial and legislative interpretations of this article, which provides a legal basis for cracking down on underworld crimes. This paper makes a preliminary analysis and discussion on the present situation and legislative situation of Chinese and foreign underworld crime, the concept and characteristics of China's underworld crime, and the application and perfection of relevant legislative provisions in our country. In addition to the introduction, this paper is divided into five parts, about 36000 words. Introduction: the harm of underworld crime, the extinction and resurgence of underworld crime in our country and the general situation of legislation about underworld crime in our country. The first chapter summarizes the development, current situation and types of underworld organizations in mainland China, introduces the general situation and legislative situation of overseas underworld organizations, and makes a brief analysis of the general structural characteristics of the crimes committed by underworld organizations in China. Chapter II: the concept, characteristics, types and cognizance of China's underworld (nature) organization are elaborated in detail, and the problems of "underworld", "underworld nature organization" and "underworld organization" are deeply analyzed and discussed. The difference between underworld organizations and "criminal gangs", "evil forces" and "criminal syndicates", "terrorist organizations", "cult organizations" and unit crimes is explained. Chapter III: the constitution and identification of the crime of organization, leadership and participation in the first paragraph of Article 294 of the Criminal Law of our country. Chapter four: the article 294, the second and third paragraph of the criminal law of our country, the constitution characteristic and cognizance of the crime of "entering and developing the members of the underworld organization" and "harboring and condoning the crime of the underworld nature organization" are analyzed. Chapter V: pointing out the defects of legislation in punishing underworld crimes, discussing the application and perfection of the current legislative provisions on underworld crimes in our country, and proposing the establishment of "organizations, leaders," "to participate in the crime of triad organization", "to shield or connive the crime of a triad organization" or to punish a typical crime of a triad organization according to the aggravated circumstances of a crime committed by a criminal organization of a triad nature, It is suggested that the crime of participating in an overseas triad organization should be added to the crime of "harbouring and conniving at the crime of criminal organizations of a black society", and that the contents of the crime committed by overseas triad organizations should be connived at. The crime of underworld crime clearly stipulates property penalty in the legislation. Key words: the study of underworld crime
