论我国农村留守儿童的监护问题

【摘要】：我国目前面临的农村留守儿童监护问题非常突出,这些问题成为保护农村留守儿童权益的重大阻碍,解决这些问题的关键是落实完善我国农村留守儿童监护法律制度。本篇论文一共从五个部分进行论述:第一部分是我国农村留守儿童监护概述,主要明确现阶段我国农村留守儿童的含义及立法现状;第二部分是我国农村留守儿童监护现状,具体阐述我国目前农村留守儿童的现存监护模式以及产生的监护问题;第三部分是我国农村留守儿童监护缺失的法律原因,从监护制度内容和监护立法体例方面阐述现行监护制度在农村留守儿童监护方面的缺陷;第四部分是我国农村留守儿童的监护制度中监护主体的法律责任,从法定监护人、其他监护人、政府、学校四方面阐述留守儿童监护制度的法律责任究竟由谁来承担的问题;第五部分是我国农村留守儿童的监护制度的完善,完善未成年人(留守儿童)的法定监护制度、规范留守儿童委托监护制度、建立留守儿童国家监护体系。
[Abstract]:In the second part , the article discusses the current situation of guardianship of the children in rural areas of our country . The fourth part is the legal responsibility of the guardianship system of the children in rural areas of our country . The fourth part is the legal guardian , the other guardians , the government and the school . The third part is to perfect the guardianship system of the children in the countryside , perfect the legal guardianship system of the minors ( to keep the children ) , standardize the guardianship system of the children ' s guardianship and establish the national guardianship system of the children .
