香港特首普选的现状分析与前景展望

【摘要】：1997年7月1日,中华人民共和国政府恢复对香港行使主权,这颗璀璨的“东方之珠”顺利地回到祖国的怀抱。在“一国两制”方针的指引下,香港特别行政区成立,开始实行“港人治港、高度自治”。由于历史的原因,香港相对内地而言属于比较发达的现代化社会,回归十八年来其民主政治的发展步伐很快。香港的政治体制以行政为主导,行政长官(简称“特首”)居于核心地位。当前,香港政改已经成为全球热门话题。具体落实2017年行政长官普选,既是香港特别行政区政府肩负的宪制责任,也是中央政府、香港特别行政区政府和广大香港市民的共同愿望。在“一国两制、港人治港、高度自治”基本方针政策的指导下,香港的政改有着光明的前景,与此同时也遇到相当巨大的挑战。本文共包括三个部分,即绪论、正文三章及结语。绪论部分主要介绍了选题的背景和由来、选题的理论与现实意义、学术界的研究现状、写作的重难点和创新点、采用的研究方法等相关问题。正文第一章从普选的有关概念入手,首先区分直选和普选,强调普选即“普及选举权”;接着对特首普选的内涵加以阐释,继而在法理上剖析其合法性与正当性,并明确指出基本法在政改中的权威地位。正文第二章聚焦当前香港特首普选的现状分析。一开始描述了普选现阶段的具体状况,包括取得的进展和面临的难题;然后重点探讨普选遭遇困局的主要原因。正文第三章着眼于香港特首普选的前景展望。开头简要介绍特首普选的未来走向;接下来详细阐述了实行特首普选所带来的具体影响,包括微观、中观和宏观三个层面;最后提出推动普选顺利开展的建设性对策。在结语部分,笔者对香港特首普选的前景给出了期许,并指出自己研究上存在的不足。
[Abstract]:On July 1, 1997, the Government of the people's Republic of China resumed the exercise of sovereignty over Hong Kong, and the resplendent "Pearl of the Orient" smoothly returned to the embrace of the motherland. Under the guidance of the principle of "one country, two systems", the Hong Kong Special Administrative region (SAR) was established to implement "Hong Kong people ruling Hong Kong with a high degree of autonomy". Due to historical reasons, Hong Kong is a relatively developed modern society relative to the mainland, and its democratic politics has developed rapidly since its return to China 18 years ago. Hong Kong's political system is executive-led, with the Chief Executive at the core. At present, Hong Kong political reform has become a global hot topic. The implementation of the 2017 universal suffrage of the Chief Executive is not only the constitutional responsibility of the Hong Kong Special Administrative region Government, but also the common aspiration of the Central Government, the Hong Kong Special Administrative region Government and the general public of Hong Kong. Under the guidance of the basic principles and policies of "one country, two systems, Hong Kong people ruling Hong Kong with a high degree of autonomy", Hong Kong's political reform has a bright future, and at the same time it has encountered considerable challenges. This paper consists of three parts: introduction, three chapters and conclusion. The introduction mainly introduces the background and origin of the topic, the theoretical and practical significance of the topic, the current situation of academic research, the important difficulties and innovations of writing, the research methods adopted and so on. The first chapter begins with the related concepts of universal suffrage, first differentiates between direct election and universal suffrage, emphasizes that universal suffrage is "universal suffrage", then explains the connotation of universal suffrage for chief executive, and then analyzes its legitimacy and legitimacy in legal theory. And pointed out clearly the basic law in the political reform authority position. The second chapter focuses on the current situation of Hong Kong Chief Executive election. It begins with a description of the current stage of universal suffrage, including progress made and challenges faced, and then focuses on the main reasons for the general election's difficulties. Chapter three focuses on the prospect of universal suffrage for the Chief Executive of Hong Kong. At the beginning of this paper, the author briefly introduces the future trend of the universal suffrage of the chief executive; then expounds the concrete influence brought by the implementation of the universal election of the chief executive in detail, including micro, medium and macro levels; finally, puts forward constructive countermeasures to promote the smooth development of the universal suffrage. In the conclusion part, the author gives the expectation of Hong Kong Chief Executive election, and points out the deficiency of his research.
