权利主张抑或利益考量:民众对社会正义客体的认知——一项以权利观念为中心的实证研究

【摘要】：公民权利是现代社会正义的最基本要求,因此,作为民众社会正义客体认知的权利观念就成为衡量社会正义程度的重要标志。对中国而言,权利这一概念属于"舶来品"。在传统社会,民众更多的是通过"气""委屈""面子""冤枉"等本土话语体系来表达利益诉求,而且相应的利益维护行为也是基于利益得失的考量而做出的。随着社会的转型,民众的权利观念也应当逐渐从基于利益得失的考量向稳定的权利观念转变。采用多元回归分析方法对民众权利观念状况影响因素的研究表明,受教育程度越高,就越有可能具有稳定的权利观念;从职业上看,与农民相比,民营部门的工作人员越有可能具有稳定的权利观念。对权利主张相关研究结论对于增强社会总体的权利观念和意识具有一定的参考价值。
[Abstract]:Civil rights are the most basic requirement of modern social justice, so the concept of rights as the object of social justice has become an important symbol to measure the degree of social justice. With the transformation of society, people's concept of rights should gradually change from the consideration of gains and losses to the stable concept of rights. This paper studies the influencing factors of people's concept of rights by multiple regression analysis. The study shows that the higher the education level, the more likely it is to have a stable concept of rights; from a professional point of view, compared with farmers, the more likely the private sector workers have a stable concept of rights.
