马克思产权理论与科斯产权理论比较研究

【摘要】：随着我国国有企业产权改革的不断深入,马克思产权理论与科斯产权理论受到了人们的广泛关注,两种产权理论之间的比较研究成为理论界关注的焦点。当前国内外学术界在对马克思产权理论与科斯产权理论比较过程中,取得了一些理论成果,但仍存在许多不足,比如,关于马克思产权理论的本质以及两种产权理论的比较研究上还存在诸多争议,没有形成完整的比较体系。本文在阐述了马克思产权理论与科斯产权理论产生过程、逻辑框架的基础上,从马克思产权理论与科斯产权理论的差异与共识这一新的切入点对两种产权理论进行了系统地比较研究,发现两种产权理论在产权的本质、范畴、起源、逻辑体系、制度变迁动因以及研究的方法和目的上存在根本差异,同时,在产权的界定、权能结构安排、产权与法律、经济效率和企业关系上存在一定的共识。通过系统地对比研究,我们认为,马克思产权理论与科斯产权理论之间既有区别又有联系；其本质是有根本差异的,马克思产权理论的本质是马克思所有制意义上的理论,而科斯产权理论的本质是法律意义上的理论。同时,这两种产权理论自身也存在不足。科斯产权理论的不足主要在于其理论本身逻辑体系不够严密,争议点很多；马克思产权理论的不足主要在于受时代局限性,对生产力相对落后的社会主义国家如何安排和调整产权关系未能做出详细地描述,对产权主客体的研究以及产权与现代企业发展之间的关系没有完整论述,其理论缺乏时代性和可操作性,因而,对马克思产权理论的研究还要进一步发展完善,做到与时俱进。通过对两种产权理论的系统比较,我们认为,在进行国有企业产权改革过程中,一方面要坚持马克思产权理论的指导地位；另一方面,也要充分吸收人类文明的一切优秀成果。
[Abstract]:With the deepening of property right reform of state-owned enterprises in our country, Marx's property right theory and Coase's property right theory have received extensive attention, and the comparative study between the two kinds of property right theories has become the focus of the theoretical circle. In the process of comparing Marx's property right theory with Coase's property right theory, the academic circles at home and abroad have made some theoretical achievements, but there are still many deficiencies, such as, There are still many disputes about the nature of Marx's property right theory and the comparative study of the two kinds of property right theories, which have not formed a complete comparative system. This paper expounds the process of the production of Marx's property right theory and Coase's property right theory. On the basis of logical framework, this paper makes a systematic comparative study on the difference and consensus between Marx's property right theory and Coase's property right theory, and finds out that the two property right theories have the essence, category and origin of property right. There are fundamental differences in logic system, institutional change reasons, methods and purposes of research. At the same time, the definition of property right, the arrangement of power structure, property right and law, There is a certain consensus on economic efficiency and enterprise relations. Through a systematic comparative study, we believe that Marx's property right theory and Coase's property right theory are both different and related, and that there are fundamental differences in their essence. The essence of Marx's property right theory is the theory in the sense of Marx's ownership, while the essence of Coase's property right theory is the theory of law. The deficiency of Coase's property right theory is that its logical system is not strict enough, and there are many controversial points, and the deficiency of Marx's property right theory is mainly due to the limitations of the times. How to arrange and adjust the relations of property rights in socialist countries with relatively backward productive forces has not been described in detail, and the research on the subject and object of property rights and the relationship between property rights and the development of modern enterprises have not been fully discussed. Therefore, the study of Marx's property right theory should be further developed and perfected to keep pace with the times. Through the systematic comparison of the two property rights theories, we believe that, In the process of property right reform of state-owned enterprises, on the one hand, we should adhere to the guiding position of Marx's property right theory; on the other hand, we should fully absorb all outstanding achievements of human civilization.
