马克思主义法治思想及其时代意蕴

【摘要】：马克思主义法治思想随着马克思主义传入中国已有百年历史，这对封建社会历史悠久的中国来说无疑是一个重大突破。尤其是从建国以来几代领导人不断地把马克思主义法治思想基本原理同我国法治建设实际相结合，形成了相对系统的中国化的马克思主义法治思想，指导着中国的法治建设，具有重大的理论意义和实践价值。对于中国共产党人对马克思主义法治思想的继承发展已经取得的成果我们不可否认，即使在风云变幻的新时期我们仍旧在受益于这些理论。 但是，也正是由于这个给人们带来了更多的机遇和挑战的风云变幻的时代。使得一部分人逐渐开始怀疑马克思主义的价值，甚至有人认为马克思主义早已过时，要寻求一个更适合当代社会发展的理论体系取而代之。因此，是否要继续发展马克思主义以及如何把马克思主义与新时期社会变化形势结合起来就成了新课题。笔者认为，马克思主义包括马克思主义法治思想在当代仍有其重要的意义。因为，马克思主义与其他理论不同，它并不是只适用于某种社会或某个时代的既定理论，而是可以应对各种社会形态和复杂环境的一种规律性的方法。马克思主义及其法治思想并不会因社会变迁而像其他理论一样被埋没在历史长河中。 为了验证这一点，在本文中，笔者对马克思主义法治理论体系进行了阐述，详细地剖析了马克思主义法治思想中国化的成果及其重要作用同时对新时期中国法治建设现状进行了揭示，以明确马克思主义法治思想在当代仍有其价值。并最终站在一个法律工作者的角度来分析新形势下如何将马克思主义法治思想与当代中国特色社会主义法治建设相结合。希望能形成人们对马克思主义法治思想的理论思考并对新时期和谐社会社会主义法治建设实践中提供些许借鉴。
[Abstract]:Marxist thought of rule of law has been introduced into China for a hundred years with Marxism, which is undoubtedly a great breakthrough for China with a long history in feudal society. In particular, since the founding of the people's Republic of China, the leaders of several generations have constantly combined the basic principles of Marxist legal thought with the reality of the construction of the rule of law in our country, forming a relatively systematic Marxist legal ideology of Marxism, which is guiding the construction of the rule of law in China. It has great theoretical significance and practical value. We can not deny the achievements that the Chinese Communists have made in inheriting and developing the Marxist thought of rule of law, even in the new period of vicissitudes, we are still benefiting from these theories. However, it is precisely because of this to bring people more opportunities and challenges of the changing times. It makes some people begin to doubt the value of Marxism gradually, and some even think that Marxism has long been out of date, to seek a more suitable theoretical system for the development of contemporary society. Therefore, whether to continue to develop Marxism and how to combine Marxism with social changes in the new period has become a new topic. The author believes that Marxism, including Marxist thought of rule of law, still has its important significance in the contemporary era. Because Marxism is different from other theories, it is not only applicable to a certain society or a certain era of established theory, but can deal with various social forms and complex environment of a regular method. Marxism and its thought of ruling by law will not be buried in the history as other theories because of social changes. In order to verify this point, in this paper, the author expounds the Marxist legal theory system. This paper analyzes in detail the achievements and important functions of the Sinicization of Marxist thought on the rule of law and at the same time reveals the present situation of the construction of the rule of law in China in order to make it clear that the thought of Marxist rule of law still has its value in the contemporary era. Finally, from the angle of a legal worker, the author analyzes how to combine the Marxist thought of rule of law with the construction of socialist rule of law with contemporary Chinese characteristics under the new situation. It is hoped that people can form the theoretical thinking of Marxist thought of rule of law and provide some reference for the construction of harmonious socialist rule of law in the new period.
