法治社会建设视域下我国公民法治观念培育研究

【摘要】：2012年11月召开的党的十八大首次提出“法治”是治国理政的基本方式,并把“法治”作为社会主义核心价值观的重要组成部分。2014年10月党的十八届四中全会召开之后,司法改革全面推行,“依法治国”这一主题再次提升到一个全民高度关注的高度。党的十八届四中全会首次专题讨论依法治国问题,并将增强全社会的法治观念作为全面推进法治社会建设和推进依法治国的一项重要任务。这说明增强全民法治观念对于全面推进法治社会建设和依法治国具有非常重要的意义。改革开放近四十年来,我国的法治建设取得了较大的成就,公民的法治观念有了很大提升,但在现今全面推进法治社会建设的大背景下,我国公民法治观念的现状与现代化法治社会建设的目标之间还有一定的差距。由于历史和现实的一些原因,公民对法治的全面认知不足,对法治的权威和信赖不够等诸多问题依然存在,这些都表明我国公民法治观念的增强仍然需要理论和实践上的不断探索,因此对公民法治观念培育问题的研究是中国特色社会主义建设和我国社会发展的一项重要研究课题,具有重要的研究意义和实际价值。本文正文分为四个部分:第一部分:对公民、法治、法治观念、法治观念培育和法治社会等相关概念进行界定,在此基础上来论述加强我国公民法治观念培育的重要性,并阐述我国公民法治观念培育的相关理论基础;第二部分:介绍我国公民法治观念培育现状,并分析我国现阶段法治观念培育中存在的主要问题,包括培育基础、培育主体、培育实效性以及培育环境四个方面;第三部分:就我国公民法治观念培育中存在的主要问题的成因进行历史与现实的探究与反思;第四部分:立足于我国的具体国情,探讨有效培育公民法治观念的方法与途径,包括加强公民法治观念培育基础建设、明确公民法治观念培育主体、增强公民法治观念培育实效性、营造公民法治观念培育良好环境四个方面。希望本文对我国公民法治观念的培育起到积极的推动作用,同时,借助对于我国公民法治观念培育的研究,为我国法治社会建设以及推进国家治理现代化提供理论和实践上的启示。
[Abstract]:The 18th National Congress of the Party held in November 2012 for the first time proposed "rule of law" as the basic way of governing the country and governing government, and regarded "rule of law" as an important part of the core values of socialism. After the fourth Plenary session of the 18th CPC Central Committee held in October 2014, The judicial reform has been carried out in an all-round way, and the theme of "governing the country according to law" has been raised to a height that the whole people are highly concerned about. The fourth Plenary session of the 18th CPC Central Committee discussed the issue of governing the country according to law for the first time, and regarded strengthening the concept of the rule of law in the whole society as an important task in comprehensively promoting the construction of a society ruled by law and promoting the rule of law. It shows that strengthening the concept of rule of law by the whole people is of great significance for promoting the construction of the society ruled by law and governing the country according to law. In the past 40 years of reform and opening up, the construction of the rule of law in our country has made great achievements, and the concept of the rule of law of the citizens has been greatly improved. However, under the background of comprehensively promoting the construction of the society ruled by law, There is still a certain gap between the present situation of the concept of civil rule of law and the goal of building a modern society ruled by law. Due to some historical and realistic reasons, the citizens' overall understanding of the rule of law is insufficient, and many problems still exist, such as insufficient authority and trust in the rule of law. All these indicate that the enhancement of citizens' concept of rule of law still needs to be explored in theory and practice. Therefore, the research on the cultivation of citizens' concept of rule of law is an important research topic in the construction of socialism with Chinese characteristics and the social development of our country. It has important research significance and practical value. The text of this paper is divided into four parts: the first part: the concept of citizens, the concept of the rule of law and the law of society and other related concepts are defined, on the basis of this to discuss the importance of strengthening the cultivation of the concept of the rule of law of Chinese citizens. The second part introduces the current situation of the cultivation of the concept of the rule of law in our country, and analyzes the main problems existing in the cultivation of the concept of the rule of law in our country, including the cultivation basis, the cultivation of the main body. The third part: to explore and reflect on the causes of the main problems existing in the cultivation of the concept of civil rule of law in China; the fourth part: based on the specific conditions of our country, the third part is to explore and reflect on the causes of the main problems existing in the cultivation of citizens' concept of rule of law. This paper discusses the ways and means of effectively cultivating citizens' concept of rule of law, including strengthening the basic construction of cultivation of concept of citizen's rule of law, clarifying the cultivation subject of concept of citizen's rule of law, and enhancing the actual effect of cultivating concept of citizen's rule of law. Build the concept of citizen rule of law to cultivate a good environment in four aspects. It is hoped that this paper will play a positive role in promoting the cultivation of the concept of the rule of law among citizens in our country. It provides theoretical and practical enlightenment for the construction of our country's society under the rule of law and for promoting the modernization of national governance.
