劳动者权力视阈下的农民工权益保障分析

【摘要】:劳动者权力包括组织性权力和结构性权力,内生于劳资关系场域,源自劳动者个体和集体组织基于劳资关系所生发的维护自身权益的力量及能力。当前农民工权益保障不力,突出表现为劳动报酬权、休息休假权、安全卫生保护权、社会保险权、职业技能培训权等并未完全落实。农民工权益保障不力的主要原因在于农民工的组织性权力和结构性权力受限。提升农民工权力是有效保障农民工权益的可行选择,应规制农民工组织依法依规发展,提高农民工组织性权力;加强农民工职业技能培训,增强农民工市场谈判权力;完善农民工社会保障体系,夯实农民工工作场所谈判权力;深化城乡二元结构体制改革,优化农民工权益保障的制度环境。
[Abstract]:Laborer's power includes organizational power and structural power. It is born in the field of labor relations, and originates from the strength and ability of individual and collective organization to safeguard their own rights and interests based on the labor relations. At present, the rights and interests of migrant workers are not well protected. Outstanding manifestations are the right to work remuneration, the right to rest and leave, the right to safety and health protection, the right to social insurance, The main reason for the weak protection of the rights and interests of migrant workers lies in the limited organizational and structural power of migrant workers. It is a feasible choice to effectively protect the rights and interests of migrant workers to promote the rights of migrant workers. It is necessary to regulate the development of migrant workers' organizations according to law, improve their organizational power, strengthen their vocational skills training, strengthen their power to negotiate in the market, perfect the social security system of migrant workers, and consolidate their negotiating power in the workplace. We will deepen the reform of the dual structure of urban and rural areas and optimize the institutional environment for the protection of the rights and interests of migrant workers.
