土地综合补偿标准的实证研究——以上海市为例

【摘要】：为了公共利益的需要国家可依法征收土地并给予补偿,但我国土地增值收益分配中所存在的非"包容性"行为必然导致土地利益分配不合理,针对土地征收补偿标准的研究已成为解决民生问题、维护社会稳定的重要课题。目前,我国以土地"原用途"为基础、以土地"年产值"倍数法为基础以及以土地"市场价值"为基础的三种征地补偿标准,都不能同时涵盖土地的经济价值、社会保障价值以及生态价值,综合补偿标准能够在一定程度上解决上述三种补偿标准的缺陷。土地综合补偿标准由于其考虑补偿因素的全面性,对于失地农民来说具有一定的公平性,达到了效率和公平的相对均衡。
[Abstract]:In order to meet the needs of public interest, the state can expropriate land according to law and give compensation. However, the non-inclusive behavior in the distribution of land value-added benefits in China will inevitably lead to unreasonable distribution of land interests. The research on compensation standard of land expropriation has become an important issue to solve livelihood problems and maintain social stability. At present, three kinds of land requisition compensation standards, which are based on land "original use", land "annual output value" multiple method and land "market value", can not cover the economic value of land at the same time. The social security value and the ecological value, the comprehensive compensation standard can solve the defects of the above three kinds of compensation standards to a certain extent. Because of the comprehensive consideration of the compensation factors, the comprehensive land compensation standard has a certain fairness for the land-losing farmers, and achieves the relative equilibrium of efficiency and fairness.
