文化产业创造力研究:机理、保障机制与激励政策

【摘要】:文化产业的转型升级和政策革新是中国深化改革追寻可持续发展大背景下的重要领域之一。我国文化产业的发展经过数十年的“热运行”,实质性“拐点”已然到来,“冷思考”显得尤为必要。从“总体性生产匮乏”到“低水平生产过剩”,从“倚赖政策红利求发展”到“激励自主创造促发展”,我国文化产业的发展处在一个关键的“拐点”和“岔道”上。摒弃以传统制造业的价值链和线性生产观念为特征的“文化制造”思维,遵循以追求核心价值附加值和高质量生产为秉性的“文化创造”模式,是文化产业高质量发展和可持续发展应有的态度。鉴于此,文化产业如何步入“文化创造”的发展模式,文化产业如何从“政策红利”转入“政策理性”的发展轨道,都是值得我们深思的课题。文化产业创造力研究即是基于“文化创造”发展模式和“政策理性”发展轨道的系统构建。文化产业创造力是文化产业走向高质量发展的根本动力;知识产权既是文化产业的核心价值又是文化产业创造力的保障机制;以文化产业创造力激励为核心的文化产业政策体系是文化产业可持续发展的制度保障。基于此,本文的研究遵从以下的思路和内容展开。(1)一个逻辑进路。将文化产业、知识产权和创造力激励三要素置于文化产业政策中进行考量是本文的基本逻辑进路。本文将在理论阐述中厘清三要素之间的关联性,在政策实践中合理安排三要素融合下的政策内容。(2)两个研究层面。一是在抽象层面,以整体的“文化产业”为对象,构建一个涉及到文化产业创造力的定义、属性、影响因素、运行机理、激励模型的理论体系。二是在具体层面,将文化产业创造力的理论体系运用到具体产业,以我国动漫产业和版权产业为对象,来探讨文化产业创造力激励政策体系在动漫产业和版权产业中的构建和完善。(3)三个研究内容。阐释“文化产业创造力”的三大内容:运行机理、知识产权保障机制和激励政策。在其运行机理的分析中,分别论述了文化产业创造力的定义、属性、影响要素、运行机理及其作用机能;在其知识产权保障机制的阐述中,剖析了文化产业与知识产权之间的关联并构建了知识产权导向下的文化产业创造力循环激励模型;在激励政策的叙述中,提出了创造力激励目标下我国文化产业政策的完善思路与对策。在此基础上,全文分为七个章节展开具体论述。第一章:绪论。介绍了本文的选题背景、选题意义、相关主题的国内外研究现状、研究目标、主要内容、创新之处、研究方法及研究思路。第二章:文化产业创造力的属性、定义及激励影响要素。首先从个体视角抑或社会文化视角、个人创造力抑或合作创造力、科学创造力抑或艺术创造力的对比中分析了文化产业创造力的属性,接着给出了文化产业创造力的定义,并进一步解析了文化产业创造力激励的影响要素。第三章:文化产业创造力的运行机理。首先依据文化产业的特性将文化产业进行解构,在结构解构的基础上阐释了文化产业创造力在文化产业不同环节和阶段中的运行机理,以及在文化产业不同链端中的作用机能。第四章:文化产业创造力的知识产权保障机制。首先分析了文化产业的核心内容与知识产权的价值传递功能、文化产业的核心价值与知识产权的制度运载作用,知识产权通过传递和运载构成文化产业创造力的保障机制。继而构建了一个“知识产权导向下的文化产业创造力循环激励模型”,从激励目标、激励对象和激励机制三个层面阐释了文化产业创造力的激励机理。第五章:文化产业创造力的激励政策。首先通过统计与分析考查了我国文化产业创造力激励政策的现状、特征与缺陷。接着根据数据搜集、整理与分析,厘清了我国文化产业创造力实践中的主要矛盾。在此基础上,从三个方面提出了创造力激励目标下文化产业政策的完善思路。第六章:具体产业分析(一):我国动漫产业创造力激励政策研究。以政策目标和内容为侧重点,首先分析了我国动漫产业创造力激励政策的基本现状,接着用比较分析的方法总结了韩国、日本等典型国家的动漫产业创造力激励政策,最后提出了完善我国动漫产业创造力激励政策的五点建议。第七章:具体产业分析(二):我国版权产业创造力激励政策研究。以政策主客体关系为侧重点,分析了我国版权产业的结构特征,继而分别给出了政府在我国版权产业创意端和市场端的应有角色以及应该行使的政府职能。第七章:结论与展望。总结了全文主要内容,对下一步的工作提出了展望。
[Abstract]:The transformation and upgrading of cultural industry and policy innovation are one of the important areas under the background of China's deepening of reform and pursuing sustainable development. After decades of "hot operation", the substantive "turning point" has come, and "cold thinking" is particularly necessary. From "overall production scarcity" to "low level production". The development of China's cultural industry is in a key "turning point" and "fork". The cultural industry policy system at the core is the institutional guarantee of the sustainable development of cultural industry. Based on this, the study follows the following ideas and contents. (1) a logical approach. The basic logic of this paper is to consider the three elements of cultural industry, intellectual property and creativity incentive in cultural industry policy. This article will clarify the relevance between the three elements in the theoretical exposition, and rationally arrange the policy content of the three elements in the policy practice. (2) two research levels. First, at the abstract level, it takes the overall "cultural industry" as the object to construct a definition, attribute, influence factor and operational mechanism involving the creativity of cultural industry. The theoretical system of incentive model. Two is to apply the theoretical system of cultural industry creativity to specific industry in specific level, taking China's animation industry and copyright industry as the object, to explore the construction and improvement of the creative incentive policy system of cultural industry in the animation industry and copyright industry. (3) three research contents. The three main contents of "industry creativity": operation mechanism, intellectual property protection mechanism and incentive policy. In the analysis of its operating mechanism, the definition, attributes, influencing factors, operating mechanism and function function of cultural industry creativity are discussed respectively, and the cultural industry and intellectual property rights are dissecting in the exposition of the system of intellectual property protection. The relationship between the cultural industry and the creative cycle incentive model under the guidance of intellectual property rights is constructed. In the narration of the incentive policy, the perfect ideas and Countermeasures of our cultural industry policy under the target of creativity incentive are put forward. On this basis, From three aspects, this paper puts forward the perfect ideas of cultural industry policy under the target of creativity incentive. The sixth chapter: specific industry analysis (1): the research of creativity incentive policy in China's animation industry. The basic status of the incentive policy of creativity in China's animation industry is analyzed with the focus of policy objectives and content. Method summed up the animation industry creativity incentive policy of Korea, Japan and other typical countries, and finally put forward five suggestions to improve the creativity incentive policy of China's animation industry. The seventh chapter: specific industry analysis (two): the research on creativity incentive policy of China's copyright industry. The structural features of the industry, and then the role of the government in the creative and market parts of the copyright industry in China and the government functions should be exercised. The seventh chapter: conclusions and prospects. The main contents of the full text are summarized, and the future work is put forward.
