清代《上谕军令条约》《行军纪律》浅析

【摘要】：正中国自古就十分重视用兵之道,而用兵首先需讲究令行禁止。所以,作为约束军队纪律的军事法很早就出现了,甚至可以说,中国传统法的起源就与军法、军律的使用有关。《尚书》中的"甘誓"、"汤誓"、"泰誓"等等,都具有早期军律的性质。周《易》中有"师出以律,失律凶也"的记载。清代战争频发,统治者更是十分重视作战和行军纪律的重要作用,先后几次制定和修正军事法,使得清代的军事法律逐渐形成一定的规范性与可操作性,具有鲜明的时代特色。清代法制一直是法制史领域研究的重点,但是对于清代军事法的研究却不多。张晋藩对于
[Abstract]:Since ancient times, China has attached great importance to the use of military forces, and the first thing to do is to stress orders and prohibitions. Therefore, the military law, as a discipline for the armed forces, has been around for a long time. It can even be said that the origin of Chinese traditional law is that of military law. The usage of the military law is related to the use of the military law. The "Gan Oath", "Tang Oath", "Tai Oath" and so on in Shang Shu are all of the nature of the early military laws. In the Zhou Dynasty, there is a record of "when the teacher gives the law, the law loses the law, but the law is also broken out." there were frequent wars in the Qing Dynasty. The rulers attached great importance to the important role of fighting and marching discipline. They formulated and amended military laws several times, which made the military laws of the Qing Dynasty gradually formed a certain degree of standardization and maneuverability. The legal system of the Qing Dynasty has always been the focus of research in the field of the history of legal system, but there are few researches on the military law of the Qing Dynasty.
