【摘要】：正《史记·李斯列传》:"二世二年七月,具斯五刑,论腰斩咸阳市。斯出狱……遂父子相哭,而夷三族。"~①按此,李斯当是二世二年七月被害。但在《史记·秦始皇本纪》中却有另一种说法:"二年……二世……下去疾、斯、劫吏,案责他罪。去疾、劫……自杀。斯卒囚,就五刑。三年……冬,赵高为丞相,竟案李斯杀之。"~②这两条记载何者为真众说纷纭。虽然清人梁玉绳认为当依本纪,~③但由于《资治通鉴》从《李斯列传》,故学界多采"二年说"。今人王叔岷先生认为:"案六国年表,二世二年书‘诛丞相斯。'与此合。"~④但个人以为,《李斯列传》的记载恐怕并不确切。《六国年表》二世二年原文为:"诛丞相斯、去疾,将军冯劫。"~⑤除李斯被杀时间以外,其他的显然与《秦始皇本
