论《太和律》及北朝法系

【摘要】：《太和律》是北魏、隋、唐诸律的嚆矢。北朝法系是礼、法两部机器的全面啮合,直接源头是太和年间孝文帝进行的礼、律修订。其指导思想是"齐之以法,示之以礼",原则是以礼入法。北朝法系奠定的历史大背景是北魏孝文帝在太和年间进行的系列性社会改革。
[Abstract]:Taihe Law is the law of the Northern Wei Dynasty, Sui Dynasty and Tang Dynasty. The law system of the Northern Dynasty is the ritual, the law of the two machines engaged fully, the direct source of the Taihe Emperor filial piety, law revision. Its guiding ideology is "Qi with the law, show by the ceremony", the principle is to enter the law. The historical background of the Northern Dynasty law system was the series of social reforms carried out by Emperor Xiaowen of the Northern Wei Dynasty during the Taihe period.
