【摘要】： 北宋在中国古代社会的发展中起着非常重要的作用。农业是立国之本,强国之基,这在北宋也不例外。北宋政府十分重视农田水利法规建设,颁布和修订了诸多相关法律条文,其规模和程度都大大超过前代,且对后世影响很深。文章以北宋农田水利法规为切入点,通过回顾北宋农田水利法规制定的历史背景,初步研究其内容及相关文献,并且介绍其执行机构和机构的运行机制,最后对北宋农田水利法规的实施效果进行评析。从古代水利法发展史来看,北宋的农田水利法规在中国古代水利法规发展史上具有非常重要的地位.而这种现象并不是偶然的,一方面,这与北宋以前我国农田水利事业和农田水利法规的发展有密切关系；另一方面,农田水利法规的出现,与北宋社会政治经济等方面的状况及宋统治者的高度重视有密切联系,它是北宋社会特定历史背景下的产物。北宋的农田水利法规,可以说是水利法规发展中的一座里程碑,涉及内容也比较多。在研究其内容时,我们选取了北宋有代表性的水利法规及相关文献,诸如：《疏决利害八条》、《农田利害条约》、《千仓渠水利奏立科条碑记》《上吕中丞书》、《答手诏条陈十事》、《水利书》和《吴中水利书》,进行逐一论述,以期管窥整个北宋时期农田水利法规的内容。北宋统治者不仅重视水利立法工作,而且重视水利法规的执行机构及职官设置,形成了完备的农田水利法规执行机构和职责明确、奖惩分明的监督运行机制。水利执法监督主要从四个方面入手：颁布法令和派人巡视；堤防管理和岁修制度；经常的疏浚和分水措施；明确治水的责任和奖惩制度。从中央到地方,从官员到百姓,形成了严密的治水体系。北宋农田水利法规的颁布及其实施,推动了农田水利事业的发展,促进了农业生产的发展,取得了较好的经济效益和社会效益,但同时应该看到农田水利法的局限性。
[Abstract]:The Northern Song Dynasty played a very important role in the development of ancient Chinese society. Agriculture was the foundation of the nation and the foundation of the powerful nation, which was no exception in the Northern Song Dynasty. The government of the Northern Song Dynasty attached great importance to the construction of irrigation and water conservancy laws and regulations, and promulgated and revised many relevant legal provisions, the scale and extent of which were much larger than those of the previous generation, and had a deep impact on future generations. By reviewing the historical background of the establishment of farmland and water conservancy laws and regulations in the Northern Song Dynasty, the paper preliminarily studies its contents and related documents, and introduces the operational mechanism of its executing agencies and institutions. From the history of ancient water conservancy law, the irrigation and water conservancy law of Northern Song Dynasty plays a very important role in the history of ancient Chinese water conservancy laws. This phenomenon is not accidental. On the one hand, it is closely related to the development of irrigation and water conservancy undertakings and laws and regulations in China before the Northern Song Dynasty; on the other hand, the emergence of farmland and water conservancy laws and regulations. It is closely related to the social, political, economic and other aspects of the Northern Song Dynasty and the importance attached to it by the rulers of the Song Dynasty, which is the product of the specific historical background of the Northern Song Dynasty. The farmland and Water Conservancy regulations of the Northern Song Dynasty can be said to be a milestone in the development of the water conservancy laws and regulations. The content involved is also more. In studying its content, we selected representative water conservancy laws and regulations and related documents in the Northern Song Dynasty. Such as: "eight articles of decisive interest", "Treaty of interest in farmland", "A Stele of Water Conservancy in Qiankang Canal", "A Stele on Lu Zhongcheng", "A Book of Ten things by hand", "Book of Water Conservancy" and "Book of Water Conservancy in Wuzhong", to be discussed one by one. The rulers of the Northern Song Dynasty not only attached importance to the legislation of water conservancy, but also attached importance to the execution of water conservancy laws and regulations and the setting up of official officers, thus forming a complete law enforcement agency and clear responsibilities for irrigation and water conservancy. Clear reward and punishment of the supervision of the operation of the mechanism. The supervision of water conservancy law enforcement mainly starts from four aspects: promulgating decrees and sending people to inspect; dyke management and annual repair system; regular dredging and water diversion measures; clear responsibility for water control and the system of rewards and punishments. From the central to the local levels, from officials to the common people, a strict water control system was formed. The promulgation and implementation of the irrigation and water conservancy laws and regulations of the Northern Song Dynasty promoted the development of farmland and water conservancy and the development of agricultural production. Good economic and social benefits have been obtained, but the limitation of irrigation and water conservancy law should be seen at the same time.
