政策与法律的互补谐变关系探析

【摘要】：政策与法律之间的互构谐变关系是共同应对社会变化的客观要求。政策和法律都代表着人民意志,都体现了一定时期人民对公平正义和秩序的追求,在本质上具有一致性。政策与法律也都无法做到完全的自给自足,政策在完善自身的同时也为法律提供了经验,法律在改进自身的同时也为政策提供参考,二者相互影响、相互建塑、优势互补、互联耦合,构成了一个完整的社会规范体系。中国共产党代表着人民的根本利益,是政策与法律同向、正向谐变的内在根据,是政策与法律的互补谐变关系的重要支点。
[Abstract]:The harmonious relationship between policy and law is an objective requirement to deal with social changes together. Policies and laws both represent the will of the people and embody the people's pursuit of fairness, justice and order in a certain period of time. There is consistency in nature. Neither policy nor law can achieve full self-sufficiency. Policy not only improves itself, but also provides experience for law. Law improves itself and provides reference for policy. The two influence each other. The Communist Party of China represents the fundamental interests of the people and is the internal basis of the policy and law in the same direction and positive harmonic change. It is the important fulcrum of the complementary and harmonious relationship between policy and law.
