公共服务社会化过程中的政府责任问题研究

【摘要】：随着我国经济和社会的不断发展和转型,政府的职能重心逐渐转移到公共服务建设上来。公共服务是公共行政的理论研究和现实实践都极为关注的问题,而公共服务的社会化则是我国改革以来推进公共服务改革和创新的重要体现。由于我们处于经济社会转型期,在公共服务社会化过程中仍存在诸多问题,例如政府倾向于推卸对基本公共服务的责任、服务社会化过程中的出现腐败行为滋生、公共服务合同机制的设计不规范、公共服务信息的不透明、公共服务供给主体发育不足等。造成这些问题的一个关键因素在于政府责任机制的缺位。根据管理主义与宪政主义的思路,公共服务社会化过程中,政府应当承担的责任包括绩效责任、契约责任、信息责任、回应责任、培育责任和公平责任。在公共服务社会化过程中,如何解决好政府责任问题是公共服务社会化能否得以顺利推进的关键。然而,在我国当前公共服务社会化进程当中,存在政府推卸公共服务责任、公共服务社会化过程中腐败滋生、公共服务合同设计不规范、信息不透明等问题。通过宪政主义与管理主义相统合的政府责任视角来看,出现这些问题的重要原因在于宪政主义与管理主义逻辑所蕴含的政府责任要求存在双重缺失。针对相关问题,提出了公共服务社会化过程中强化政府责任的基本逻辑：首先,应当统合管理主义与宪政主义的责任机制,在管理主义与宪政主义理论相统一的基础上建立分析公共服务社会化过程中政府责任的规范分析框架；其次,应确保公共服务社会化以实现公共利益为最终目的,应当在程序和结果两个方面维护公共利益,平衡多维责任。强化政府的具体路径则应通过各种管理技术和方法来推动政府责任机制在绩效管理、契约维护、信息透明、回应公众、培育供给主体、维系社会公平等多方面的责任,推动我国公共服务社会化实践的能顺利实现目标。
[Abstract]:With the development and transformation of our country's economy and society, the focus of government's function is gradually transferred to the construction of public service. Public service is an issue of great concern in the theoretical research and practical practice of public administration, and the socialization of public service is an important embodiment of promoting the reform and innovation of public service since the reform of our country. Since we are in the economic and social transition period, there are still many problems in the process of socialization of public services. For example, the government tends to shirk its responsibility for basic public services, and corruption occurs in the process of socialization of services. The design of public service contract mechanism is not standard, the information of public service is not transparent, and the main body of public service supply is underdeveloped. A key factor in these problems is the absence of government accountability mechanisms. According to the ideas of managementism and constitutionalism, in the process of socialization of public service, the responsibility of government includes performance responsibility, contract responsibility, information responsibility, response responsibility, cultivation responsibility and fair responsibility. In the process of public service socialization, how to solve the problem of government responsibility is the key to the smooth promotion of public service socialization. However, in the current process of public service socialization in China, there are some problems such as government shirking public service responsibility, corruption breeding in the process of public service socialization, non-standard design of public service contract, opaque information and so on. From the perspective of the combination of constitutionalism and managementism, the main reason for these problems lies in the double deficiency of the demands of government responsibility contained in the logic of constitutionalism and managementism. In view of the related problems, this paper puts forward the basic logic of strengthening government responsibility in the process of socialization of public service: firstly, the responsibility mechanism of managementism and constitutionalism should be integrated. On the basis of the unity of managementism and constitutionalism, the normative analysis framework of government responsibility in the process of socialization of public service should be established. Secondly, the ultimate purpose of public service socialization should be to realize public interest. The public interest should be maintained in both procedure and result, and multi-dimensional responsibility should be balanced. To strengthen the specific path of government, we should promote the responsibility of government responsibility mechanism in performance management, contract maintenance, information transparency, response to the public, cultivate the main body of supply, maintain social equity and other responsibilities through various management techniques and methods, such as performance management, contract maintenance, information transparency, and so on. Promote our country public service socialization practice can realize the goal smoothly.
