非法权的“外在批判”——布坎南对马克思正义概念的解读

【摘要】：自政治哲学兴起以来,国内外涌现出一大批学者对政治哲学的基本问题——正义问题展开广泛深入的研究。在西方众多政治哲学流派当中,尤其在分析的马克思主义流派中,艾伦·布坎南是一位非常出色的代表。他立足于对马克思的正义问题的分析,通过对马克思的"共产主义"思想的理解,重新构建了马克思的正义问题的逻辑框架。布坎南在批判伍德、霍尔姆斯特伦等人的观点的过程中为马克思的正义理论正名,并提出马克思在对资本主义进行批判的时候,不是从正义和权利的法权概念视角出发的,马克思的"正义"是非法权的"外在批判"。
[Abstract]:Since the rise of political philosophy, a large number of scholars at home and abroad have carried out extensive and in-depth research on the basic problem of political philosophy-justice. Among many political philosophy schools in the West, especially in the Marxist school of analysis, Alan Buchanan is a very outstanding representative. Based on the analysis of Marx's problem of justice, he reconstructed the logical frame of Marx's problem of justice through the understanding of Marx's thought of "communism". Buchanan corrected Marx's theory of justice in the process of criticizing the views of Wood and Holmstellen, and pointed out that when Marx criticized capitalism, he did not start from the perspective of the concept of justice and the right of law. Marx's Justice is the external criticism of illegal right.
