中国金融转型秩序的制度分析

【摘要】：金融转型是经济转型的核心构成内容和发展保障。但现实中,金融发展相对滞后、金融失序和无序现象时有发生、金融功能发挥不足,其结果,给市场经济的发展造成严重阻碍。基于此,有必要探讨金融转型秩序型构问题,探究其影响因素、作用机理、现实障碍以及破解对策,以期推动金融转型目标实现、促进经济深化发展。本文以制度分析方法为基本研究方法,沿着“理论分析——实践反思——完善创新”的思路进行研究。在对金融转型秩序决定因素理论阐释和现实状况客观评价基础上,考虑金融日新月异发展、金融全球化国际化的背景,系统梳理金融发展、新制度经济学的相关理论,从模仿与创新、历史与现代等角度,对已经形成的金融制度、金融文化和制度环境三维框架加以全面认真审视,探讨它们对于秩序型构的作用机制,挖掘根源,层层递进,对中国金融制度创新中的理论与实践问题作出解答。我国进行金融转型是符合生产关系一定要适合生产力发展状况的规律和金融深化要求的,也是实现经济改革目标的基本途径。金融转型总体目标是要由计划金融向市场金融、封闭金融向开放金融、传统金融向现代金融转型,最终实现金融结构体系合理、各子系统协调有序、稳定发展、公平竞争的秩序型构目标。转型期,我国金融运行与发展秩序与最终目标存在差距,它不利于金融深化目标实现。如何改变金融转型过程中的失序状态?理论上,金融结构体系、信任基础、正式制度、金融文化、政治经济体制、市场环境等因素均会对金融秩序产生影响,但制度是秩序型构的决定因素。它能够约束政府防止权力滥用、约束平等经济主体维护公平竞争、提供信息形成稳定预期、促进合作建立良好秩序。由此,失序状态的解决要着眼于制度创新。我国金融制度供求状况与变迁特点影响转型秩序型构。政府主导的金融制度供给存在供给缺乏适应性的缺点,这会造成金融供给不能满足需求的困境。供求非均衡下的强制性制度变迁不能完全破解困境。其结果,既得利益者易陷入金融寻租腐败,而缺乏制度支持的需求者在现实利益的驱使下则有可能突破制度约束铤而走险,诱发金融失序。不仅如此,我国金融契约、产权制度不成熟、金融主体行为规则不完善、政府与市场关系不明晰,这些均会给我国金融交易秩序、竞争秩序与管控秩序的型构带来阻碍。为此,转轨国家要不断解决此问题。除了上述正式制度外,价值信念、伦理规范等非正式制度也会对金融秩序型构产生影响。转型期,计划经济的思维、制度与举措尚未退出国家权力与社会运行空间,市场经济思维、制度尚在建构中。这种情况下,非正式制度的稳定性被打破,非正式规则易出现变形扭曲,对新秩序型构产生阻滞作用。金融转型是一个系统工程,它还需要特定的制度环境以保障各项制度的实施。目前我国金融转型面临着比较严峻的法律环境、体制环境和市场环境,它对制度保障和秩序型构带来制约。未来,我国金融制度要在正式制度、非正式制度和制度环境三个层面谋求供给创新。正式制度供给创新的总体思路：借助地方政府力量,发展中间扩散型制度创新模式；树立金融制度服务实体经济功能观,回归制度本源；加强民营、外资和地方性金融制度供给,夯实制度需求主体。具体的金融制度供给创新对策是：构筑金融产权制度,提升金融组织绩效；保障金融契约履行,稳固金融交易基础；改革金融主体进出与运营制度,保障金融竞争秩序；创新金融管控制度,解锁金融压制体制；完善金融市场中介组织制度,弥补市场与政府失灵。非正式制度供给创新的总体思路：构建有利于促进非正式制度完善的制度保障机制；树立与市场经济相适应的金融价值观,发挥意识形态引导作用；培育夯实金融文化基础。制度环境优化层面,第一要着眼于金融立法、执法、司法三个方面优化法律环境。第二促成政治体制和经济体制相辅相成、共同发展优化体制环境。最后要优化市场环境。金融转型秩序型构中,制度环境、正式制度与非正式制度三者合力作用发挥极其必要。因此,要夯实制度环境基础,发挥好制度环境支持力作用；要理性建构正式制度,减少与非正式制度的摩擦；还要加强非正式制度与正式制度的融合,保障正式制度实施。惟有三者相辅相成,才能推动金融转型秩序型构目标顺利实现。

In the transition period , the financial system of our country is not mature , the financial subject ' s behavior rules are not perfect , and the government and the market relationship are not perfect . In the future , the financial system of our country faces a severe legal environment , the system environment and the market environment .

Strengthening the supply of private , foreign and local financial systems and tamping the system demand subject . The specific financial system supply and innovation countermeasure is to construct the financial property right system and improve the financial organizational performance ;
Guarantee the performance of financial contract and stabilize the foundation of financial transaction ;
Reform the system of entry and exit and operation of the financial subject and guarantee the financial competition order ;
To innovate the financial control system and unlock the financial repression system ;
Perfect the system of financial market intermediary organizations , make up the market and the government failure . The general idea of the informal system supply innovation : to construct the system safeguard mechanism which is beneficial to promote the consummation of the informal system ;
Set up the financial values that are compatible with the market economy and play an ideological guidance role ;
In order to optimize the market environment , the system environment , the formal system and the informal system play an extremely important role .
To rationally construct formal system , reduce the friction with the informal system ;
It is necessary to strengthen the integration of the informal system and the formal system and guarantee the implementation of the formal system . Only the three mutually reinforce each other in order to promote the smooth realization of the constitutive goals of the financial transformation order .
