【摘要】：我国学术期刊发展迅猛,以数字化形式被商业数据库全面收录,使得学术期刊使用量大幅提升,著作权交易频繁。作为汇编作品的学术期刊,著作权存在重叠性,涉及的著作权主体众多且分散。对学术期刊复制权、信息网络传播权等著作权中经济权利的管理,适用于著作权集体管理,利于保障学术期刊著作权交易中权利人的权益特别是其经济权利。对比国内外著作权集体管理模式及其组织运营,发现我国现有著作权集体管理模式下,学术期刊著作权的集体管理没有发挥出积极作用。数字传播背景下,著作权集体管理组织未对学术期刊实行著作权集体管理,学术期刊著作权由出版单位自行管理,学术期刊著作权人难以从著作权交易中获得匹配的报酬。著作权集体管理制度不完善、组织发展缓慢、认知度不高、学术期刊著作权交易中的商业价值未受到重视等多重原因造成我国学术期刊著作权难以实现集体管理。针对我国学术期刊著作权集体管理存在的问题及其原因,结合国外相对成熟的著作权集体管理模式,基于我国具体国情,提出完善我国现有模式和提升学术期刊著作权人著作权集体管理意识的建议,并提出设立学术期刊著作权集体管理分支机构的设想。为强化对学术期刊著作权集体管理的主动性和积极性,分析组织建设中会员制度、监督机制、使用费收取分配等如何落实。
[Abstract]:The rapid development of academic journals in China, which is fully included in the commercial database in the form of digitization, makes the use of academic journals greatly increase, and the copyright transactions are frequent. It is used as an academic journal to compile works. There is overlap in copyright, which involves numerous and scattered copyright subjects. The management of economic rights in copyright, such as the right to copy academic journals and the right to disseminate information on the Internet, is applicable to the collective management of copyright. It is helpful to protect the rights and interests of the right holders, especially their economic rights in the copyright transaction of academic periodicals. Comparing the domestic and foreign copyright collective management mode and its organization and operation, we find that under the existing copyright collective management mode in our country. The collective management of the copyright of academic periodicals has not played a positive role. Under the background of digital communication, the collective management organization of copyright has not carried out the collective management of the copyright of academic periodicals. The copyright of academic periodical is managed by the publishing unit itself, the copyright owner of academic periodical is difficult to get the matching reward from the copyright transaction, the system of collective management of copyright is not perfect, the organization develops slowly, and the recognition is not high. The commercial value of academic periodical copyright transaction has not been paid attention to, and so on, which makes it difficult to realize collective management of academic periodical copyright in our country, aiming at the problems and reasons of the collective management of academic periodical copyright in our country. Combined with the relatively mature foreign copyright collective management model, based on the specific conditions of China, the author puts forward some suggestions to improve the copyright collective management consciousness of academic periodical copyright owners. In order to strengthen the initiative and enthusiasm of the collective management of the copyright of academic periodicals, this paper analyzes the member system and supervision mechanism in the construction of the organization. How to implement the collection and distribution of user fees.
