【摘要】：以法理学与经济法学的法律关系主体理论为基础,结合现行安全生产法的具体规定,我国的安全生产法律关系主体主要包括生产经营行为主体、安全监管主体、社会主体和劳动主体四类。生产经营行为主体即实施生产经营行为,包括各类生产、使用、经营、运输和存储行为的行为主体。安全监管主体,即安全生产监督管理主体,是安全生产法上依法履行对保证生产经营行为安全实施的外部监督管理职责的公权力主体。社会主体是安全生产法体现新时期安全生产社会共治理论以及经济法中"政府—社会—市场"三维层次理论的重要法律关系主体。劳动主体是依法与生产经营单位建立劳动法律关系从事生产经营劳动,并依据安全生产法具有安全生产权利和义务的主体。以上四类主体之间基于一定的法学原理发生的具有安全管理法律意义的结构性关系的整体,可以认为是安全生产法上构建的具体的多维主体框架结构。生产经营行为对安全要素的有效配置是这一多维主体框架结构的价值核心,安全管理职能的协调分配是这一多维主体框架结构的中心线索。生产经营单位应当承担本体性的安全管理职能对单位的生产经营行为采取自我保障安全的管理措施;安全监管主体应当凭借一定的主体结构构建和权力形式配置,实现一种行为主体外部的强制性公权力安全监管;社会主体作为脱胎于市民社会处于市民社会与政治国家中间层的相对独立的主体则应当承担一定的参与安全监督和管理的职能;劳动主体基于劳动安全本身的价值重要性和相对独立性,应当通过一定的劳动安全权利义务配置,对生产经营单位的劳动安全乃至整个生产安全保障发挥能动的主体功能。在各自明确承担一定的安全管理职能的基础上,协调各自的安全管理职能的发挥是这一多维主体框架结构的重点。本体性的安全管理是一种相对的生产经营行为安全保障闭环机制,但同时应当接受来自外部的公权力安全监管、社会主体参与安全监督和管理以及来自内部的劳动安全监督管理的不同程度的约束;公权力安全监管是公权力因素作用于安全生产法的体现,也是彰显经济法价值精神的标志之一。这一安全监管既应当辅助协调本体性安全管理,又应当组织协调社会主体的参与安全监督和管理,同时也应当积极依法接受源自社会的参与安全监督管理的各种参与意见和参与决策;社会主体的参与安全监督和管理作为一种社会性、参与性的安全监督和管理,需要在与本体性安全管理和公权力安全监管的相互联系、相互作用下发挥其功能,作用到对生产经营行为配置安全要素的干预之上;劳动主体的劳动安全权利义务下的在单位内部的安全管理和监督凭借与本体性安全管理的相互联系和相互作用,发挥相应的安全管理功能和意义。诚然,在一定意义上讲安全生产法的多维主体框架结构本身也是一种围绕生产经营行为配置安全要素这一价值核心的多元安全管理职能分配架构。很大程度上而言,未来的安全生产法主体机制的改革与发展,也是围绕着如何更加优化的分配各自的安全管理职能而展开的。

To a large extent, the reform and development of the main mechanism of the future safety production law also revolves around how to optimize the distribution of their respective security management functions.
