社会治理法治化视域中的深圳市征信体系建设问题

【摘要】:作为中国改革开放以来的第一个经济特区---深圳,不仅代表中国改革开放的窗口,目前也已经发展为重量级的国际化城市,创造了具有一定影响力的深圳速度。近年来,深圳市以权力公开透明运行为主线,以政风民风“双严管”为抓手,强化制度设计,创新工作机制,完善信征体系平台的建设,相关组织应该积极构建“以道德为支撑、以法律为保障”的社会信用体系,有力地促进了全县经济社会全面发展。然而,社会上总存在一些不可避免的道德风险和信息不对称风险,所以深圳市各种信用缺失的情况仍然依旧普遍存在,有些甚至恶化为更加严重的信用危机。社会信用即将个人信用,企业信用和政府信用有机的组合。这是社会信用在个人信用的基础上,企业信用是社会信用的主体,政府信用是关键,社会信用。缺乏社会信用不仅体现在个人信用和企业信用的缺乏,更强烈的政府信用缺失,示范效应。尽管复杂的原因之一,但缺乏法律和一体化的规则无疑是问题的关键所在。因此,法治是我们的重点应是为了加强政府的信用,以承认和保护个人和企业的信用权的角度看,基于法治建设的功能整合社会信用体系,实现社会信用的健康成长。本文试图通过详细研究信用与信用管理的相关理论以及一般特性,同时借鉴和吸收发达国家建立社会信用管理制度的经验与教训,设计社会治理法治化视域中的深圳市的社会征信管理体系,以寻求解决深圳市当前面临的征信体系建设困境的途径。本文旨在从政府干预市场的视角,从社会治理法治化视域中提出如何构建深圳市征信体系建设体系,形成以道德为支撑、法律为保障的社会信用制度,增强全社会信用意识,把“守法、守信,向善、向上”作为公民的基本行为规范,并最终为社会信用水平的提高提供制度保障。在确定社会治理法治化视域中的深圳市征信体系建设目标及思路基础上,提出相应的深圳市征信体系建设对策。为保障深圳市征信体系建设对策的有效性,论文的第五部分还相应的研究了社会治理法治化视域中的深圳市征信体系建设的保障措施。
[Abstract]:As the first special economic zone since China's reform and opening up, Shenzhen not only represents the window of China's reform and opening up, but also has developed into a heavyweight international city, creating a certain impact of Shenzhen speed. In recent years, Shenzhen has taken the open and transparent operation of power as the main line and the "double strict management" of the political style and the people as its grasp, strengthened the system design, innovated the working mechanism, and improved the construction of the platform of the information system. The relevant organizations should actively construct the social credit system which is supported by morality and guaranteed by law, which can promote the overall economic and social development of the whole county. However, there are always some inevitable moral hazard and information asymmetry risk in the society, so the situation of credit deficiency in Shenzhen is still widespread, and some even deteriorate to more serious credit crisis. Social credit is an organic combination of personal credit, enterprise credit and government credit. This is social credit on the basis of personal credit, enterprise credit is the main body of social credit, government credit is the key, social credit. The lack of social credit is reflected not only in the lack of personal credit and enterprise credit, but also in the more intense lack of government credit and the demonstration effect. For all its complexity, the lack of laws and rules of integration is certainly at the heart of the problem. Therefore, the rule of law should be our focus in order to strengthen the credit of the government, to recognize and protect the credit rights of individuals and enterprises, to integrate the function of the construction of the rule of law into the social credit system, and to realize the healthy growth of the social credit. This paper attempts to study the relevant theories and general characteristics of credit and credit management in detail, and at the same time draw lessons from the experience and lessons of establishing social credit management system in developed countries. In order to find a way to solve the dilemmas of credit system construction in Shenzhen City, the author designs the social credit management system of Shenzhen City from the perspective of social governance and rule by law in order to find a way to solve the problem of the construction of credit system in Shenzhen. The purpose of this paper is to put forward from the perspective of government intervention in the market, from the perspective of social governance by law, how to construct the credit information system of Shenzhen City, to form a social credit system supported by morality and guaranteed by law, and to strengthen the credit consciousness of the whole society. It regards "abiding by the law, keeping promise, being good and upward" as the basic behavior norm of the citizen, and finally provides the system guarantee for the improvement of the social credit level. On the basis of determining the construction objectives and ideas of the credit system in Shenzhen in the perspective of social governance, this paper puts forward the corresponding countermeasures for the construction of the credit information system in Shenzhen. In order to ensure the effectiveness of the construction of credit system in Shenzhen, the fifth part of this paper also studies the guarantee measures of the construction of credit system of Shenzhen in the perspective of social governance by law.
