法律思维视域下竞技性体操竞赛规则框架的分析研究

【摘要】：随着人们对体育赛事的关注度不断提高,运动竞赛过程中时常出现的争议问题不禁引起人们对竞赛公平性与合理性的拷问。通过对运动竞赛中争议案例的分析,发现竞赛规则的缺陷能够导致争议的发生,运动竞赛的公平有序进行依赖于规则的规范。通过对竞技性体操竞赛规则的研究,发现项目间规则框架构成不统一且规则内容排布顺序不一致,说明规则的编写缺乏统一和严格的标准,影响了规则的严谨性和规范性。社会的公平、正义、自由和秩序等的价值体系需要实体性的法律来捍卫,在运动场上竞赛的公平、公正和秩序则需要由运动竞赛规则来维护。将竞技性体操竞赛规则框架与法的构造框架进行对比,二者间有较大差异,其中的一些差异与争议的发生不无关系,例如竞赛规则中普遍缺少关于监督运动竞赛参与者行为的中立单位或组织的规定,即关于仲裁委员会的规定,这显然不利于运动竞赛在公平合理的环境下进行,无法保障运动竞赛规则其目标和价值的实现。如何对运动竞赛规则进行规范和完善,使它的作用得以实现和更好地服务于运动竞赛与促进运动项目的发展,是一个亟待研究与探索的课题。本研究以竞技性体操运动中的竞技体操、艺术体操、竞技健美操、蹦床和啦啦操五个项目的竞赛规则框架为研究对象,采用文献资料法、专家访谈法、比较研究法和逻辑分析法等研究方法,在法律思维视域下根据法的结构构造理论与这五个体操竞技运动项目的竞赛规则的整体框架、各部分内容构成和结构顺序等方面进行分析对比研究。针对在运动竞赛规则框架结构上发现的差异,研究运用法学和体育学等学科理论,着重论述竞赛规则框架的构成、规则结构组成顺序和规则各部分内容所体现出的意义及作用,在法律思维视域下以法的构造理论为依据,结合体育运动竞赛的特点和需求,从法学角度提出运动竞赛规则框架构成包括规则的总则、分则和附则三部分。规则的总则部分包括规则的目的、规则的根据、规则的原则、规则的效力和规则的适用共五部分内容,首次提出应把关于仲裁委员会的规定纳入到运动竞赛规则中,使涉及争议的相关当事人诉之有处和诉之有理;规则的分则部分包括对竞赛参与者的规定和要求、对比赛项目的规定、比赛成绩认定的详细依据和标准和对违反纪律的规定共四部分内容;规则的附则部分包括名词、术语的定义,解释权的授权规定和规则失效或废止的规定共三部分内容。以期从法学视角下为体操运动竞赛规则的完善和发展提出依据和标准,提高竞赛规则的严谨性和规范性,最终促进运动项目发展。
[Abstract]:With the increasing attention paid to sports events, the controversial issues that often arise in the process of sports competitions cause people to question the fairness and reasonableness of competitions. Through the analysis of the dispute cases in sports competitions, it is found that the defects of competition rules can lead to disputes, and the fair and orderly conduct of sports competitions depends on the rules. Through the study of competitive gymnastics competition rules, it is found that the frame of rules between items is not uniform and the order of rules content is not consistent, which shows that the compilation of rules lacks uniform and strict standards, which affects the rigor and normality of rules. The value system of social fairness, justice, freedom and order needs to be safeguarded by entity law, and fair play in sports field, justice and order need to be safeguarded by the rules of sports competition. Comparing the framework of competitive gymnastics rules with the frame of construction of law, there are great differences between them, some of which have something to do with the occurrence of disputes. For example, the general lack of provisions in the rules governing the conduct of neutral units or organizations that supervise the conduct of participants in sports competitions, that is, provisions on arbitration commissions, is clearly not conducive to the conduct of sports competitions in a fair and reasonable environment. It is impossible to guarantee the realization of the goal and value of the rules of sports competition. How to standardize and perfect the rules of sports competition so that its function can be realized and better serve the development of sports competition and sports items is an urgent subject to be studied and explored. This research takes the competitive gymnastics, rhythmic gymnastics, competitive calisthenics, trampoline and cheerleading in the competitive gymnastics as the research object, adopts the method of literature, expert interview, The comparative research method and the logic analysis method, under the legal thought field of view, according to the structure construction theory of the law and the whole frame of the competition rules of the five gymnastic competitive sports, Each part of the content of the composition and structure of the comparative study of the order and other aspects. In view of the differences found in the framework structure of the rules of sports competition, this paper studies and applies the theories of law and physical education, focusing on the composition of the framework of the competition rules, the order of the composition of the rules structure and the significance and function of the contents of each part of the rules. Based on the construction theory of law and the characteristics and demands of sports competition, this paper puts forward the framework of the rules of sports competition from the angle of law, which includes three parts: general rule, sub-rule and supplementary rule. The general part of the rules includes five parts: the purpose of the rules, the basis of the rules, the principles of the rules, the validity of the rules and the application of the rules. The rules include provisions and requirements for participants in the competition, provisions for the events of the competition, The detailed basis and standard for the determination of competition results and the provisions for violation of discipline are four parts; the supplementary part of the rules includes the definition of nouns, the definition of terms, the authorization provisions of the power of interpretation and the provisions of invalidation or annulment of the rules. From the perspective of law, this paper puts forward the basis and standard for the perfection and development of gymnastics competition rules, improves the preciseness and standardization of competition rules, and finally promotes the development of sports items.
