从医讼案看民国时期西医在华传播的一个侧面

1930 年代，医讼特别是西医诉讼案频繁发生。通过对诉讼档案的文本解读，可以清晰地观察到西医自身的诸多特质与我国本土的文化传统存有张力。西医所欲建构的新型医业伦理以及新式医疗手段的应用与近代国人对医家的疑惧心理形成很大的反差，这些都在医讼中有着淋漓尽致的体现。西医医讼的日益凸显，真实地反映了民国时期西医在华传播的一个侧面。

In the 1930s, the medical lawsuits especially the western medicine lawsuits happened frequently. From the interpretation of lawsuit archives, we could observe clearly the tension between the western medicine’s characteristics and the local cultural tradition. More specifically speaking, the construction of the western medicine’s ethics and the application of the new medical instruments formed a great contrast with the apprehension of the Chinese people. The phenomenon which western medicine’s lawsuits become prominent increasingly reflects an aspect of the transmission of the western medicine in the republic of China.
