日韩《儿童福利法》制定与发展变革比较研究

【摘要】：日本、韩国《儿童福利法》的制定都不是经济发展的结果,而是政治的需要。日本受佛教影响,并主动学习西方儿童救助理论;韩国则是受天主教的影响,被动接受西方提供的儿童福利设施,推行儿童福利社会工作。虽然两国儿童福利的发展在很大程度上是为了应对老龄化与少子化,但日本儿童福利的发展变革滞后于其经济发展与福利国家建设,韩国儿童福利的发展则与经济、福利国家建设同步;韩国已完全内化了儿童权利及其基本原则和系统理念,日本对儿童权利则一直停留在训示性规定层面。我国目前急需、也完全可以制定一部《儿童福利法》作为儿童福利法律体系的基本法,明确儿童福利责任主体、基本原则和基本理念。
[Abstract]:The formulation of the Child Welfare Law in Japan and Korea is not the result of economic development, but the need of politics. South Korea is influenced by Catholicism, passively accepting the child welfare facilities provided by the West and promoting child welfare social work, although the development of child welfare in both countries is to a large extent to cope with aging and minority children. However, the development and transformation of Japanese child welfare lags behind its economic development and welfare state construction, while the development of Korean child welfare is synchronized with the construction of economy and welfare state. South Korea has completely internalized the rights of the child and its basic principles and systematic concepts, while Japan has been staying at the level of prescriptive provisions for children's rights. It is also possible to formulate a basic law of the Child Welfare Law as a legal system for child welfare, and to clarify the subject, basic principles and basic concepts of the responsibility for child welfare.
