设区市立法权行使的困境与对策

【摘要】：我国地方性法规数量庞大,调整的社会关系广泛,与人民群众的现实生活息息相关,同时地方性法规作为我国现阶段最为重要的制定法在协调中央与地方关系、维护我国社会主义社会法制统一、完善地方自治等方面扮演了重要的角色,地方性法规立法质量的高与低直接关系到行政与司法的公正。过去的一年里地方性法规立法质量问题表现尤为紧迫与突出,2015年《立法法》修改后赋予了设区的市地方性法规的立法权,全国各地设区市在拥有地方性法规立法权后,开始着手行使法律赋予的立法权。在地方性法规立法主体扩大后一年有余的时间里,从各地反映的实际情况发现由于地方性法规立法主体扩大引发了若干问题,这些问题既包括实体问题也包括程序问题,甚至还出现了一些体制性问题。最为主要的问题是立法主体的下探可能会带来立法质量的下滑,如何保障地方性法规的立法质量是当前较为突出与急迫的问题。《立法法》赋予设区市地方性法规立法权是弘扬我国社会主义民主健全社会主义法治进程的重要一步,对设区市地方性法规立法权行使中产生的问题进行深入分析后研究其原因并给出可行对策以为各设区市行使地方立法权时进行参考和借鉴。

The main problem is the legislative body dropping may lead to the decline in the quality of legislation, how to guarantee the quality of legislation of the local laws and regulations is the Legislative Law > currently. Outstanding and urgent to set up local regulations of city legislative power is to promote China's socialist democracy and improve the socialist legal process is an important step to set up local regulations, district city produce right in the exercise of problems in-depth analysis of the reasons and proposes feasible countermeasures that the municipalities and districts to exercise the local legislative power for reference and reference.
