【摘要】：在科学技术飞速进步与快速发展的条件下,经济也开始进入到了大发展、大繁荣的时代。此时在经济基础的强有力支持下,民众便开始了对“上层建筑”领域的追求。学界将上层建筑拆分为思想层面上的和政治层面上的,其中思想上层建筑包括:政治法律思想、道德、宗教、文学艺术、哲学等意识形态;政治上层建筑囊括了警察、法庭、监狱、政府机构、军队、政党和社会集团等。我们的理论学术研究就属于思想上层建筑层面的内容,本文所讨论的便是美国法社会学家劳伦斯·M·弗里德曼的法律思想理论。从学术派系来看,劳伦斯·M·弗里德曼受到了现实主义法学的一些影响,从一个基本的社会视角来概括法的现象,再进一步构建统一的理论体系,也正是因此他的理论展示了法社会学概论的一种典型。劳伦斯?M?弗里德曼研究美国的法律文化是通过运用法社会学的研究方法,在研究中他没有讨论法律文化这个抽象的概念,而是从美国人当时的具体权利意识作为研究开端。他认为美国的法律文化已经从曾经的追求自由、平等和公正演变为一种对个人主义和个人选择的崇尚。人们可以在很多层面来谈论、理解法律文化。弗里德曼不是像其他人一样从内部观察,但他却是从外部来观察,试图从社会科学观点研究法、法律和法律制度。文中从弗里德曼在其专著中所描述的当代美国社会的现状、人们的思想观念入手,来探析美国的法律文化以及弗里德曼的法律文化观。
[Abstract]:The rapid progress in science and technology and the rapid development of the economic conditions, also began to enter into a big development and prosperity of the era. At this point in the economic basis of the strong support, people began to "superstructure" in the field of academic pursuit. The superstructure is split into layers on the surface of the ideological and political level among them, the ideological superstructure include: political and legal ideology, morality, religion, literature and art, philosophy and ideology; political superstructure include police, courts, prisons, government agencies, armed forces, political parties and social groups. The theory of academic research is our ideological superstructure level, is discussed in this paper the United States law sociologist Laurence M of Freedman's legal theory. From the academic faction, Laurence M Freedman has been some impact of legal realism, from a basic social From the perspective of the generalization phenomenon, and further build a unified theoretical system, it is therefore his theory shows a typical introduction to sociology of law. Laurence? M? American legal culture research on Freedman is through the use of research methods of Sociology of law, he did not discuss the abstract concept of legal culture in the study but, from the Americans at the specific rights consciousness as the research start. He thinks the legal culture in the United States have had from the pursuit of freedom, equality and justice evolution as a kind of individualism and individual choice. People can advocate in many aspects to discuss, understand the law culture. Freedman is not like other people seen from the inside, but he is looking outside, trying to from the point of view of research methods of social science, law and legal system. Contemporary American agency Freedman described in the monograph in the The present situation of the meeting and the ideas of the people, to explore the legal culture of the United States and Freedman's view of the law and culture.
