新农村建设中的法律文化现代化研究

【摘要】：在大力推进社会主义新农村及法治国家建设的今天,实现农村法律文化现代化在一定程度上具有重大而深远的意义。法律文化现代化就是要建立一套与现代市场经济和民主政治相适应的并由现代化的主体所自觉接受的法律制度体系和动态的法律观念体系。我国的法律文化现代化是一个由传统人治型法律文化向现代法治型法律文化转型的过程。然而,受历史文化以及农村特殊性的影响,我国农村是法律文化现代化建设的薄弱环节。目前,我国农村法律文化在本质上仍然属于传统法律文化范畴,其保守与落后性并未发生根本变化,与法律文化现代化相去甚远,这严重影响了新农村建设的步伐。因此,对农村法律文化的现代化进行理性与实证研究,理应成为新农村建设中不可回避的重大课题。新农村建设和法律文化现代化是互动的关系。新农村建设必然要求实现法律文化现代化。法律文化现代化既是新农村建设的题中之义,又是发挥农民主体作用和实现新农村目标的必然要求。同时,法律文化现代化能有力地促进新农村建设。它不仅有助于农村市场经济体制和民主政治体制的建立和完善,而且有助于农民法律意识的加强。现阶段我国农村法律文化现代化面临的困境具体表现为：农村法律制度缺失、农民现代法律意识贫乏、农村法律文化基础脆弱等。而农村法律制度建设不足、传统法律文化影响至深、农村市场经济体制尚未完善等则是造成困境的主因。实现我国农村法律文化现代化主要有以下途径：首先,充分发挥国家的主导作用。具体有以下途径：加强国家在法治方面的作用；加快国家在农村法律设施方面的建设；加大国家在农村法律教育方面的投入等。其次,切实突出农民的主体地位。具体有以下途径：全面提高农民的现代化综合素质；积极培养农民的法律意识；不断加强对农村法律资源的供给等。再次,夯实农村法律文化的建设基础。具体有以下途径：以农村经济体制改革激发其内在动力；以民主政治建设激发其直接动力；以理性文化营造良好的法律文化环境等。在新农村实现现代化法治化的背景下,我国农村法律文化的现代化迎来了空前的发展机遇,同时也面临着新的挑战,对此,我们必须予以高度的认识。只要我们坚持党的领导,立足中国农村的实际,理性地分析存在的问题及成因,科学构建农村法律文化现代化的理想模式,找准有效的实现途径和方法,就可达成农村法律文化现代化的目标,并促成社会主义新农村的早日实现。
[Abstract]:In promoting the new socialist countryside and the construction of rule of law today, realize the modernization of legal culture to a certain extent, has significant and far-reaching significance. The modernization of law culture is to establish a modern market economy and democratic politics and legal system to adapt to the dynamic and conscious of the acceptance by the subject of modern law the concept of system. China's modernization of legal culture is a traditional man ruling legal culture to the modern legal legal cultural transformation process. However, under the influence of historical culture and the particularity of rural areas, rural China is a weak link in the modernization of law culture. At present, China's rural legal culture still belongs to the traditional legal culture in essence, the conservative and backward sex have not changed fundamentally, and a far cry from the modernization of legal culture, which seriously affected the construction of New Countryside Therefore, a rational and Empirical Study of the modernization of rural legal culture should be an important and unavoidable issue in the construction of new rural areas.
The new rural construction and modernization of legal culture is the interactive relationship. The new rural construction necessary to realize the modernization of legal culture. The modernization of legal culture in the new rural construction is the problem of justice, and is the inevitable requirement of farmers to play the main role and achieve the goal of the new countryside. At the same time, the law culture modernization can effectively promote the construction of new countryside. It not only help to establish and perfect the rural market economic system and the democratic political system, but also helps to strengthen the law consciousness of the peasants.
The present predicament of modernization of law culture in our country are as follows: lack of legal system in rural areas, farmers lack of modern legal consciousness, legal culture foundation of rural fragility. While the rural legal system construction, the traditional legal culture influence to the deep reason, the rural market economic system is not yet perfect is the cause of the trouble.
China's rural modernization of legal culture has the following main ways: first, give full play to the leading role of the country. The following specific ways: strengthen the role of the state in terms of the rule of law; speeding up the construction of national law facilities in rural areas; the government increase investment in rural education law and so on. Secondly, to highlight the dominant position of the farmers. The following way: in order to improve the comprehensive quality of modern farmers; actively cultivate the legal consciousness of the farmers; strengthen the supply of rural legal resources. Thirdly, tamp the foundation of rural law culture. Specifically in the following ways: the rural economic system reform to stimulate their intrinsic motivation; stimulate the direct impetus to the construction of democratic politics; with the rational culture to create a good legal and cultural environment.
In the background of modernization of the rule of law in new countryside, China's rural modernization has ushered in unprecedented opportunities for development, while also facing new challenges, in this regard, we must be highly aware of. As long as we adhere to the leadership of the party, based on the actual Chinese in rural areas, problems and causes of the rational analysis of the the ideal model, construct the modernization of law culture in the rural scientific way of finding effective, can reach the goal of modernization of the rural legal culture, and contribute to the early realization of the new socialist countryside.
