习惯进入国家法之国外情况考察

【摘要】：在西方法律发展的历史进程中,习惯对法律的制定和发展有着重要影响和参考作用。法国"向居民进行的"习惯法依据调查,为制定符合法国国情的民法典和相关法律提供了立法基础,在当代习惯仍是国家立法的重要法源。在德国法律发展史上产生重要影响的历史法学派强调,真正意义上好的法律,是建立在习惯法的基础上体现着一个国家"民族精神"的法律。在英国,以判例法方式表现出来的普通法传统,就是在习惯法基础上建立起来的。国外习惯入法的历程以及现今习惯在立法和司法中的地位和价值,对于我国重视和加强民间习惯的研究,思考习惯对我国国家法的法源意义,有一定借鉴和参考价值。
[Abstract]:In the historical process of the development of western law, custom plays an important role in the formulation and development of law. It provides a legislative basis for the formulation of the civil code and related laws in accordance with the national conditions of France, and is still an important legal source of national legislation in the present age. The historical school of law, which has an important influence in the history of the development of German law, emphasizes that the law in the true sense is good. It is a law based on customary law that embodies the "national spirit" of a country. In England, the common law tradition is expressed in the form of case law, It is established on the basis of customary law. The process of foreign custom entering the law and the status and value of custom in legislation and judicature today, for our country to attach importance to and strengthen the study of folk custom, consider the legal significance of custom to our country's national law. There is certain reference and reference value.
