专利专门性法院的先驱者——美国联邦巡回上诉法院的发展

【摘要】：美国联邦巡回上诉法院是美国历史上第一所,也是唯一一所对专利案件有专门性管辖权的上诉法院,该院的建立一度备受质疑与苛责,而数年的发展完善令其成为美国科技高速进步的重要推进者,而该法院也成了此后建立的日本、韩国、我国台湾地区等地的知识产权法院相继学习的楷模。本文将以实践为基础,从历史背景出发,分析联邦巡回上诉法院的设立,运行与司法影响。
[Abstract]:The Federal Circuit Court of appeals is the first history of the United States, is also the only one to have the special patent case appellate court jurisdiction, establish the hospital once been questioned and criticism, and several years of development it has become an important advance of American science and technology to improve the speed of progress, and the court has become established since then Japan, South Korea, a model of intellectual property court of Taiwan area in China have been learning. This paper is based on the practice, starting from the historical background, analysis of the establishment of the Federal Circuit Court of appeals, operation and judicial effect.
