【摘要】：随着我国法治进程的加快,地方立法数量不断增加,地方立法中的部门利益问题日益凸显出来。其具体表现形式是通过立法来维护、加强和扩大本部门的权力,减少和减弱本部门应承担的责任和义务。如何有效地遏制地方立法中的部门利益倾向,不仅关系到每一个公民的权利和义务,而且对提高立法质量也有着重要的现实意义。所以,如何界定地方立法中部门利益的内涵,分析其具体的表现形式及成因,以及提出对其有效的法律控制的方式是本文的主要目的。本文从理论和实证两个角度着手,结合大量地方立法实践的案例和数据,对地方立法中的部门利益问题进行了研究,对控制地方立法中部门利益的倾向提出了制度上的解决方法
[Abstract]:With the acceleration of the process of rule of law in our country, the number of local legislation is increasing, and the problem of departmental interests in local legislation is increasingly prominent. Its concrete manifestation is to safeguard, strengthen and expand the power of this department through legislation. How to effectively curb sectoral interest tendencies in local legislation is not just about the rights and obligations of every citizen, Therefore, how to define the connotation of the department interests in the local legislation, analyze its concrete manifestation and cause of formation, The main purpose of this paper is to put forward the effective legal control. In this paper, from the theoretical and empirical perspectives, combined with a large number of cases and data of local legislative practice, this paper studies the sectoral interests in local legislation. This paper puts forward the institutional solution to the tendency of controlling the departmental interests in the local legislation.
