论法学家在构建法治社会中的作用

【摘要】：人类社会的历史，就是一部法学家的法律思想史。正是法学家们在法学领域付出的辛勤和汗水，推动了世界法制文明的发展。随着我国法治国家目标的确立，法学家的作用进一步凸显。法学家在构建法治社会中的作用如此重要，而对这一问题的系统研究却相当匮乏。如果对这一问题认识不清，必然影响我国的法治进程。本文尝试着对法学家在构建法治社会中的作用问题进行探讨，，希望能够对我们的法治国家建设有所帮助。本文将从分析法学家在法治社会中的地位以及法学家的应然作用入手，继而进一步探讨法学家发挥应然作用的条件机制，最后还将探讨法学家作用的异化和防范。我们认为，只有弄清了这些问题，才能更好地发挥法学家的作用，也才能更好地推动我国的法治国家建设。
[Abstract]:The history of human society is the history of legal thoughts of jurists. It is the hard work and sweat of jurists in the field of law that have promoted the development of the world legal civilization. With the establishment of the goal of our country ruled by law, The role of jurists is further highlighted. The role of jurists in building a society governed by the rule of law is so important, and systematic research on this issue is rather scarce. This paper attempts to probe into the role of jurists in the construction of a society ruled by law. This paper will analyze the position of jurists in the society of rule of law and the role of jurists, and then further explore the conditions and mechanisms for jurists to play their due role. Finally, we will discuss the alienation and prevention of jurist's role. We believe that only by making clear these problems, can we better play the role of jurists and promote the construction of our country under the rule of law.
