【摘要】：中国环境法学界对环境法学方法论的研究给予了极大的关注并投入了巨大的精力,也确实收获了一定的成果。然而,各个学者的观点迥然不同,由此引发的论战让学者们精心构建的方法论理论大厦受到了不同程度的撼动。加之对环境法适用和环境法学研究方法的具体指导作用并不明确。环境法学方法论研究在繁华之后面临着昙花一现的窘境。对环境法学方法论研究路径的反思势在必行。不识庐山真面目,只缘身在此山中。对环境法学方法论研究路径的思考,必须摆脱某种具体的方法论观点的桎梏才有望收获。本文首先对环境法学方法论相关概念、理论进行剖析和明确,发现目前环境法学方法论研究在初始阶段已经可能出现了路径偏差;接着通过经济法学方法论研究前车之鉴,得出对环境法学方法论研究或有价值的四点启示;然后对我国环境法学方法论的各种观点进行评析,发现我国环境法学方法论研究在初始路径上犯了和经济法学方法论研究相似的错误,四点启示的意义不仅是参考价值更是切实纠偏的重要手段;最后,基于四点启示,对环境法学方法论的研究路径:环境法本体论、“人的模式”构建的意义及标准、其他环境学科之于环境法学方法论之意义等重要内容作一初步分析,以期对我国环境法学方法论研究在方向上给予一定意义的指引。
[Abstract]:Chinese environmental law circles have paid great attention to the research of environmental law methodology and put great efforts into it. However, the views of different scholars are very different. The resulting controversy has shaken the theoretical edifice of methodology carefully constructed by scholars to varying degrees. In addition, the specific guidance to the application of environmental law and the research methods of environmental law is not clear. The methodology of environmental law is not clear. It is imperative to reflect on the research path of environmental law methodology. If we don't recognize the true features of Lushan, we should only find ourselves in this mountain. To think about the research path of the methodology of environmental law, we must get rid of the shackles of some specific viewpoint of methodology in order to be able to gain results. First of all, this paper is concerned with the related concepts of methodology of environmental law. Through theoretical analysis and clarification, it is found that the current research on methodology of environmental law has already appeared the path deviation in the initial stage, and then through the study of the methodology of economic law, Four valuable revelations to the study of environmental law methodology are obtained, and then the various viewpoints of environmental law methodology in China are analyzed and analyzed. It is found that the study of environmental law methodology in our country has made mistakes similar to those of economic law methodology in the initial path. The significance of the four points of enlightenment is not only the reference value but also the important means to correct the deviation; finally, based on the four points of enlightenment, This paper makes a preliminary analysis on the research path of the methodology of environmental law: the ontology of environmental law, the significance and standard of the construction of "human model", and the significance of other environmental disciplines to the methodology of environmental law. The aim is to give some guidance to the research of environmental law methodology in China.
