论我国法治化进程中的道德整合

【摘要】：道德整合是指社会成员形成道德共识并保持这种道德共识的稳定而不涣散的状态和维系机制。中国传统社会的道德整合依赖于政治权力，政治精英代表着社会的道德形象，，对社会的道德整合发挥着重要的作用。在西方法治社会，宗教体系具有道德整合的功能，这种功能有利于避免社会现代化转型中的道德危机。中国法治化进程中，人们在逐步吸收和对法治理念理解的同时，也对中国传统的儒家德治思想展开了学理上的批判和清算，削弱了传统社会国家政权的道德整合功能；宪政的制度设计更是否定了传统政治精英的道德权威，中国传统道德整合机制解体了，这是中国法治化进程中道德危机的重要原因。要解决法治化进程中的道德危机，关键是重新审视政治与道德的关系，立足我国的传统，重新构建符合我国法治社会的道德整合机制。现代法治社会的政治实践，不能完全排除政治精英的道德责任。中国共产党具有深厚的道德资源的优势，对我国法治化进程中的道德整合应发挥特殊的作用。
[Abstract]:Moral integration refers to the social members forming a moral consensus and maintaining a stable and consistent state and maintenance mechanism of the moral consensus. The moral integration of Chinese traditional society depends on political power, and the political elite represents the moral image of the society. It plays an important role in the moral integration of society. In the western society ruled by law, the religious system has the function of moral integration, which is helpful to avoid the moral crisis in the transformation of social modernization. While gradually absorbing and understanding the concept of rule by law, people criticize and liquidate the traditional Confucian rule of virtue in China, which weakens the function of moral integration of the state power in the traditional society. The system design of constitutionalism negates the moral authority of the traditional political elite, and the mechanism of Chinese traditional moral integration disintegrates, which is an important reason for the moral crisis in the process of rule of law in China. The key is to re-examine the relationship between politics and morality, based on the tradition of our country, to rebuild the moral integration mechanism in accordance with the rule of law in our country, and the political practice of the modern society ruled by law. The Communist Party of China has the advantage of deep moral resources and should play a special role in moral integration in the process of ruling by law in our country.
