关于我国房地产“政策”的法律思考

【摘要】:住房是人们不可缺少的基本生活资料,住房问题是一个重大的社会经济问题,这个问题解决的好坏,直接关系着一个国家的稳定和经济的发展。目前国家为了规范好房地产市场,颁布了一系列的法律法规和出台了很多政策。政策是国家或政党为实现一定的政治、经济、文化等目标任务而确定的行动指导原则与准则。通过制定政策,以确定行动的目的、方针和措施。法律是由一定的物质生活条件所决定的,由国家制定或认可并由国家强制力保证实施的具有普遍效力的行为规范体系,其目的在于维护、巩固和发展一定的社会关系和社会秩序。政策主要是从宏观上进行指导房地产市场,法律是从具体上进行规范保障。关于政策和法律之间的关系在理论上有很好的界定。但国家目前颁布的政策和法律对于房地产市场的运行虽然起到了一些的作用,但是效果并不明显。 近几年来,房价上涨过快,国家为了调控房地产市场,出台了很多政策,主要涉及金融、土地和税收等方面。虽然国家调控的力度越来越大,但是房价依然是越调越高。这说明了国家在处理房地产问题上的方向存在着一定的问题。目前我国房地产市场已具有了很大的市场规模,国家依靠频频出台房地产政策来调控房地产市场是远远不够的。本文从政策和法律的关系入手,接着列举国家出台的政策,在宏观上指出国家依靠出台的政策是不能满足需要的;从具体的政策内容上指出其存在的不合理和不合法的地方,得出国家主要应该依靠法律手段调控,而不是依靠经济手段,当前国家应尽快加快完善房地产法律体系的步伐。同时,由于房地产关乎我国经济的稳定,国家进行干预是必不可少的,但是要适度,而且国家在出台政策时也要遵循一定的原则。 本文首先介绍了政策和法律概念,以及两者之间的联系和区别。其次对目前房地产政策进行分析,主要对2003年以来的房地产政策进行归纳总结,将其分为几个阶段,以便从宏观上进行把握,然后以此指出房地产政策中存在的问题。最后针对这些问题,分别从政策、法律的角度提出了一些完善建议。
[Abstract]:Housing is an indispensable basic means of livelihood, housing is a major social and economic problems, this problem is good or bad, directly related to a country's stability and economic development.At present, in order to standardize the real estate market, the country has promulgated a series of laws and regulations and issued a lot of policies.Policy is the guiding principle and rule of action that the state or political party determines to achieve certain political, economic, cultural and other objectives.By formulating policies to determine the objectives, guidelines, and measures of action.The law is a universal system of norms of conduct determined by certain material living conditions, formulated or approved by the state and guaranteed by the state to enforce it, the purpose of which is to maintain,Consolidate and develop certain social relations and social order.The policy is to guide the real estate market macroscopically, and the law is to standardize the protection.The relationship between policy and law is well defined in theory.However, the policies and laws issued by the state have played some roles in the operation of the real estate market, but the effect is not obvious.In recent years, house prices have risen too fast. In order to regulate the real estate market, the state has introduced many policies, mainly related to finance, land and taxation.Although the state regulation and control is more and more strong, but house prices are still higher and higher.This shows that there are certain problems in the direction of dealing with real estate problems.At present, the real estate market of our country already has a very large market scale, it is far from enough for the country to rely on the real estate policy to adjust and control the real estate market frequently.This article starts with the relationship between the policy and the law, then enumerates the policies issued by the state, pointing out from a macro perspective that the state can not meet the needs by relying on the policies issued, and pointing out the unreasonable and illegitimate areas of its existence from the concrete policy content.It is concluded that the state should mainly rely on legal means to regulate and control, rather than on economic means, and that the country should speed up the pace of perfecting the legal system of real estate as soon as possible.At the same time, because the real estate is related to the economic stability of our country, it is necessary for the state to intervene, but it should be moderate, and the state should follow certain principles when issuing the policy.This paper first introduces the concept of policy and law, as well as the relationship and difference between the two.Secondly, it analyzes the current real estate policy, mainly summarizes the real estate policy since 2003, divides it into several stages, in order to grasp from the macro, and then points out the problems in the real estate policy.Finally, some suggestions are put forward from the angle of policy and law to solve these problems.
