论授予较大市完整立法权

【摘要】：十八届三中全会决议提出逐步扩大有立法权较大市的范围,反映现代城市管理中对地方立法权的现实需求。现行较大市立法中的批准制度反映当时法制建设的实际状况,却带有强烈的行政色彩,模糊了各级人大之间法律监督关系,混淆立法权与立法监督权,忽略了较大市立法责任,制约备案审查制度的完善。树立法治思维,完善法规备案审查制度,授予较大市完整的法规制定权。现代宪法理论中,作为根本法的宪法不仅仅是国家权力的依据,更是国家权力运行底线,根据实际需要,全国人大立法授予较大市完整立法权并不存在宪法障碍,因而也无须修改宪法。
[Abstract]:In modern constitution theory , the constitution of the National People ' s Congress ( NPC ) is not only the basis of the State power , but also the state power running bottom line . In the modern constitution theory , the constitution of the National People ' s Congress ( NPC ) is not only the basis of State power , but also does not have constitutional obstacles , so it is not necessary to amend the constitution .
