论三国两晋南北朝礼法结合及其当代思考

【摘要】：法治和德治是治理国家社会的重要手段,我国三国两晋南北朝时期引礼入律,礼法结合,是法律儒家化的重要时期。本文着重从诉讼法律、刑事法律、民事法律等方面依据史实列举了三国两晋南北朝礼法相n并济具体表现,最后提出了历史上礼法结合对当前全面推进依法治国的思考。
[Abstract]:The rule of law and the rule of virtue are the important means of governing the state and society. During the period of the three Kingdoms Jin and Southern and Northern dynasties, the introduction of etiquette into the law and the combination of etiquette and law are the important periods of the Confucianization of law.Based on the historical facts, this paper enumerates the concrete performance of the etiquette law of the three Kingdoms Jin, Southern and Northern dynasties, and finally puts forward some thoughts on how to promote the rule of law in an all-round way in the history.
