【摘要】：正德国思想家康德在《实践理性批判》一书中写道:"有两样东西,越是经常而持久地对它们进行反复思考,它们就越使心灵充满常新而日益增长的惊赞和敬畏:在我头上的星空和我心中的道德法则。"(1)每逢品读自己钟爱的这段格言,总不免怀想:倘若道德与法律之间并非一些人所宣称的"上帝归上帝,恺撒归恺撒"那么简单,法律中的道德孕育将会成就怎样的图景,那行地江河、同辉日月的崇高道德法则,又将如何引领人们通往良法善治之路?
[Abstract]:Kant, the German thinker, wrote in his critique of practical reason: "there are two things that the more often and continuously think about them,The more they fill the heart with new and growing admiration and awe: the starry sky above my head and the moral law in my heart.I can't help but wonder: if the relationship between morality and law is not as simple as some claim, "God is God, Caesar is Caesar", what kind of picture will be achieved by moral gestation in the law?How will the lofty moral principles of the sun and moon lead people to the path of good law and good governance?
