中美食品安全监管机制比较研究

【摘要】:食品的安全性都是各国政府和消费者关注的重点问题,若不幸发生食品安全事故,甚至会引起一定范围的社会动荡。在我国,食品安全这个话题并不轻松,近年来的食品安全事故暴露了我国在食品安全监管方面的漏洞。本文在解释食品和食品安全的涵义的基础上,对中美两国的食品安全立法、食品安全监管主体和食品安全召回制度进行对比。全文分为四部分: 第一部分为概念界定,这部分对食品、食品安全、监管和监管制度的涵义进行了阐述,并对容易混淆的概念进行了区分。 第二部分对中美两国立法现状进行了研究,重点是介绍食品安全监管的主要法律法规,并归纳了中美立法的相同点,比较了中美立法的不同点,在此基础上,借鉴美国立法的先进之处对我国立法的完善提出建议。 第三部分对中美两国的监管主体构成和职能进行了介绍,并归纳了中美两国监管主体的相同点,比较了中美两国监管主体的不同点,并在此基础上借鉴美国监管主体构成和职能划分的先进之处对我国监管主体的完善提出建议。 第四部分对食品安全监管的补救措施——食品召回制度进行了研究,同样是先对两国的食品召回制度进行介绍,并归纳了中美两国食品召回制度的相同点,比较了中美两国食品召回制度的不同点,,并在此基础上借鉴美国食品召回制度的先进之处对我国食品召回制度的完善提出了建议。
[Abstract]:Food safety is the focus of attention of governments and consumers. If food safety accidents occur unfortunately, it will even cause social unrest in a certain range. In our country, the topic of food safety is not easy, food safety accidents in recent years have exposed the loopholes in food safety supervision. On the basis of explaining the meaning of food and food safety, this paper compares the food safety legislation, the main body of food safety supervision and the food safety recall system between China and the United States. The full text is divided into four parts: The first part is the definition of the concept, which expounds the meaning of food, food safety, supervision and supervision system, and distinguishes the easily confused concepts. The second part studies the current legislation of China and the United States, focusing on introducing the main laws and regulations of food safety supervision, and summarizes the similarities of Chinese and American legislation, compares the differences between Chinese and American legislation, and on this basis, Using the advanced aspects of American legislation for reference, some suggestions are put forward for the perfection of our legislation. The third part introduces the composition and function of the main body of supervision in China and the United States, sums up the similarities of the subjects of supervision between China and the United States, and compares the differences of the subjects of supervision between China and the United States. On the basis of this, some suggestions are put forward for the perfection of the supervisory subject in our country by drawing lessons from the advanced parts of the composition and function division of the supervisory subject in the United States. The fourth part has carried on the research to the food safety supervision remedial measure-the food recall system, also has carried on the introduction to the two countries' food recall system, and has summed up the similarities between China and the United States food recall system. The differences of food recall system between China and the United States are compared, and on the basis of this, suggestions are put forward to improve the food recall system in China based on the advanced points of the food recall system in the United States.
