选贤举能、良法之治与国家治理的现代化——治理理论视域中的贿选及其规制

【摘要】：国家治理的现代性建构,其核心就是"良法善治"。选举是国家治理现代化和法治化的前提中的前提,要件中的要件。然而,"辽宁贿选案反"映出,贿选不仅冲击了国家治理的正当性、妨碍了国家治理的有效性,而且在客观上也消解了国家治理的公信力,最终对全面深化改革和全面依法治国造成根本性的破坏。为了有效规制贿选,应当推进制度建构,其中包括:选举过程中实现党要管党、从严治党,以法家的重刑主义惩治贿选,发展和完善适合于中国特色社会主义民主政治的选举制度。
[Abstract]:The core of the modern construction of state governance is good law and good governance. Election is the premise of the modernization of national governance and the rule of law. However, the "Anti-bribery case in Liaoning Province" reflects that bribery not only impinges on the legitimacy of national governance, hinders the effectiveness of national governance, but also objectively dispels the credibility of national governance. In the end, it will cause fundamental damage to deepening the reform and ruling the country according to law in an all-round way. In order to regulate bribery election effectively, we should promote the construction of system, which includes: the party should be in charge of the party in the election process, the party should be administered strictly, and the bribery should be punished with the severe punishment of the legalists. To develop and improve the electoral system suitable for socialist democratic politics with Chinese characteristics.
