法儒文化视角下中国劳动关系治理的演进

【摘要】:从中国本土的法家"法治"视角和儒家"仁治"视角分析了新中国成立以来劳动关系治理的演变路径。改革开放前,劳动关系治理实践具有社会主义背景下国家行政调整和协调的特征;改革开放后,强调"法治"的刚性治理和正式化调整"法治型实践"特征突出,劳资矛盾开始增多,一些企业随后主动调整劳动关系治理策略,"仁治型实践"出现,重视和尊重员工权益。既强调正式化治理与硬性约束,又体现非正式化治理与软性约束的"法仁双元型实践"为劳动关系治理提供了中国特色和谐劳动关系的一种实现路径。
[Abstract]:This paper analyzes the evolution of labor relations governance since the founding of New China from the perspective of "rule of law" by local legalists and Confucian "benevolence". Before the reform and opening up, the practice of labor relations governance had the characteristics of national administrative adjustment and coordination under the socialist background, and after the reform and opening up, the rigid governance of "rule of law" and the formal adjustment of "practice of rule by law" were prominent. The contradiction between labor and capital began to increase, and some enterprises took the initiative to adjust the management strategy of labor relations, and the "benevolence practice" appeared, paying attention to and respecting the rights and interests of employees. Both formal governance and rigid constraints, but also informal governance and soft constraints of the "law benevolence dual practice" for labor relations governance provides a way to achieve harmonious labor relations with Chinese characteristics.
